Can Android 1.6 devices be upgraded to Android 2.x for free?

I'm a bit confused on what the license/deployment policy for Android is really like. Is it an open source OS in the same sense as let's say a normal Linux distro ?

If I have an Android 1.6 device, can I simply install the latest version of Android on it free of charge, or is there a lot more to it ?

I take it, it's not just a download and install workflow.
