  • How can I most efficiently communicate my personal code of ethics, and its implications?

    There is a lot to the definition of a professional. There are many questions here asking how to identify components of what is essentially a professional programmer - how do you identify or communicate expertise, specialization, high quality work, excellent skills in relation to the profession. I am specifically looking for methods to communicate a specific component, and I quote from wikipedia: A high standard of professional ethics, behavior and work activities while carrying out one's profession (as an employee, self-employed person, career, enterprise, business, company, or partnership/associate/colleague, etc.). The professional owes a higher duty to a client, often a privilege of confidentiality, as well as a duty not to abandon the client just because he or she may not be able to pay or remunerate the professional. Often the professional is required to put the interest of the client ahead of his own interests. How can I most efficiently communicate my professionalism, in the spirit of the quote above, to current and potential clients and employers?

On several occasions this year I was asked for advice that amounts to answering ethical questions, in a computer programming context, and I was surprised to see how much fretting and trouble questions which I consider trivial can lead to. Are there any courses or programs specializing in teaching what is expected of an ethical programmer? Has anyone put together a formal curriculum anywhere?

  • Questionable ethics regarding closed source softwares which are supposed to be open source.

    Several days ago I heard a sentence "Cracking company name routers are not a crime.". I asked "Why?" and the guy explained to me that company name used a linux distribution on their routers which source can not be closed because of their license but company name closed it. What do you think about this? Doing otherwise unethical "cracking" becomes ethical, or somewhat neutral if the software in question is "cracked" too? By "cracking" I don't mean breaking into a computer through someones' company name router but "cracking" my own router's OS which otherwise would be unethical.

    First bit of the question: What are the legal requirements of LGPL code during the deployment of a commercial product? Software package should include LGPL licence file Anything else? Shall we add a line to our "software agreement text" where you need to click next in the installer ? Second bit, Is there any known / accepted ways of distributing the changed library. Since it's LGPL anything derived from it should be licenced under LGPL. But what about after that? Shall we just send a copy to the original author? Shall we put it in our website so people can download? Or ship the source code with the product? Or just put a note that saying "e-mail us for the source code of this library".

  • Website Ethics / legal issues, image copyrights

    Ignoring the technical implementation of a website for a second, assume a website that is similar to twitter but with pictures. A user say something and puts a picture of whatever they said. As the nature of the internet, the images will most likely not be his/hers image. There are 2 options that I see for dealing with this: 1. The user will post a URL of the picture and the website will pull the picture from that URL everytime someone enters that page 2. The website will save the image in its own database of images and display the image to the visitors 'locally' The problem with option #1, while it saved storage, I see an issue with 'stealing' other websites bandwidth and if my website has many many visitors it could cost the image-hosting websites a lot and possible even crash it if the server can't handle the load. The problem with opion #2, while it saves the load to other websites, it practically takes pictures that could have copyright on them. Which option is better to implement in terms of legal issues and ethics? When do I need to contact another website to request permission to use the images from that site? Does anyone really care about that anymore. Where can I read about this?

    Developer Training - Importance and Significance - Part 1 Developer Training – Employee Morals and Ethics – Part 2 Developer Training – Difficult Questions and Alternative Perspective - Part 3 Developer Training – Various Options for Developer Training – Part 4 Developer Training – A Conclusive Summary- Part 5 If you have been reading this series of posts about Developer Training, you can probably determine where my mind lies in the matter – firmly “pro.”  There are many reasons to think that training is an excellent idea for the company.  In the end, it may seem like the company gets all the benefits and the employee has just wasted a few hours in a dark, stuffy room.  However, don’t let yourself be fooled, this is not the case! Training, Company and YOU! Do not forget, that as an employee, you are your company’s best asset.  Training is meant to benefit the company, of course, but in the end, YOU, the employee, is the one who walks away with a lot of useful knowledge in your head.  This post will discuss what to do with that knowledge, how to acquire it, and who should pay for it. Eternal Question – Who Pays for Training? When the subject of training comes up, money is often the sticky issue.  Some companies will argue that because the employee is the one who benefits the most, he or she should pay for it.  Of course, whenever money is discuss, emotions tend to follow along, and being told you have to pay money for mandatory training often results in very unhappy employees – the opposite result of what the training was supposed to accomplish.  Therefore, many companies will pay for the training.  However, if your company is reluctant to pay for necessary training, or is hesitant to pay for a specific course that is extremely expensive, there is always the art of compromise.  The employee and the company can split the cost of the training – after all, both the company and the employee will be benefiting. [Click on following image to answer important question] Click to Enlarge  This kind of “hybrid” pay scheme can be split any way that is mutually beneficial.  There is the obvious 50/50 split, but for extremely expensive classes or conferences, this still might be prohibitively expensive for the employee.  If you are facing this situation, here are some example solutions you could suggest to your employer:  travel reimbursement, paid leave, payment for only the tuition.  There are even more complex solutions – the company could pay back the employee after the training and project has been completed. Training is not Vacation Once the classes have been settled on, and the question of payment has been answered, it is time to attend your class or travel to your conference!  The first rule is one that your mothers probably instilled in you as well – have a good attitude.  While you might be looking forward to your time off work, going to an interesting class, hopefully with some friends and coworkers, but do not mistake this time as a vacation.  It can be tempting to only have fun, but don’t forget to learn as well.  I call this “attending sincerely.”  Pay attention, have an open mind and good attitude, and don’t forget to take notes!  You might be surprised how many people will want to see what you learned when you go back. Report Back the Learning When you get back to work, those notes will come in handy.  Your supervisor and coworkers might want you to give a short presentation about what you learned.  Attending these classes can make you almost a celebrity.  Don’t be too nervous about these presentations, and don’t feel like they are meant to be a test of your dedication.  Many people will be genuinely curious – and maybe a little jealous that you go to go learn something new.  Be generous with your notes and be willing to pass your learning on to others through mini-training sessions of your own. [Click on following image to answer important question] Click to Enlarge Practice New Learning On top of helping to train others, don’t forget to put your new knowledge to use!  Your notes will come in handy for this, and you can even include your plans for the future in your presentation when you return.  This is a good way to demonstrate to your bosses that the money they paid (hopefully they paid!) is going to be put to good use. Feedback to Manager When you return, be sure to set aside a few minutes to talk about your training with your manager.  Be perfectly honest – your manager wants to know the good and the bad.  If you had a truly miserable time, do not lie and say it was the best experience – you and others may be forced to attend the same training over and over again!  Of course, you do not want to sound like a complainer, so make sure that your summary includes the good news as well.  Your manager may be able to help you understand more of what they wanted you to learn, too. Win-Win Situation In the end, remember that training is supposed to be a benefit to the employer as well as the employee.  Make sure that you share your information and that you give feedback about how you felt the sessions went as well as how you think this training can be implemented at the company immediately.   • Ethics of soliciting App store app reviews?

    I see more than a few developers soliciting 5-star ratings and good reviews for their App store apps, in their blogs, websites, app store descriptions, even dialogs that pop-up in the app after you've used them for awhile. What do people consider to be the ethical guidelines regarding such review and ratings solicitations? What's over the line? (Besides obviously evil stuff, such as paying to have someone forge multiple negative reviews about your competitor's apps, etc.)

    When I co-oped during college, I had to fill out an evaluation of the co-op afterwards. One metric I always had to rate was how much the company required me to "Make ethical decisions related to your profession." This always seemed kinda silly- I mean, my first co-op was writing java apps to manage industrial radios. There wasn't much moral ambiguity going on. Anyway, I'm wonder what sort of ethical dilemmas one might actually encounter in software development. Edit: It should be noted that no ethically-trained software engineer would ever consent to write a DestroyBaghdad procedure.   • How to avoid being forked into oblivion by a more powerful contributor?

    As recently reported here: Xamarin has forked Cocos2D-XNA, a 2D/3D game development framework, creating a cross-platform library that can be included in PCL projects. However the founder of the project that was forked says: The purpose of the MIT license is to unencumber your fair use. Not to encourage you to take software, rebrand it as your own, and then "take it in a new direction" as you say. While not illegal, it is unethical. It seems that the GitHub page of the new project doesn't even indicate that it's a fork in a typical GitHub manner, opting for an easily-removable History section instead (see bottom). So my questions are: Was Xamarin's action and the way the action was done ethical or not? Is it possible to avoid such a situation if you are a single developer or a small unfunded group of developers? I am hoping this could be either a wiki question or there will be some objective answers grounded on modern OSS ethics/philosophy.

  • Ethics of assisting other programmers, where do we draw the line?

    In general, not just in relation to stackoverflow, sometimes I'm asked a programming question for which the answer will probably be used for good purposes, but there is a chance that it could not be. Two recent examples which reminded me of some real world questions I've been asked are: Send email to many users, and keep a formless application from closing for a keyboard hook Though I don't believe the intent of the authors of those questions is in any way nefarious, occasionally someone does ask such a question for purposes of aiding a spamming effort, or creating a keylogger. Even though the questioner and answerers had good intent, a 3rd party could pervert those answers to create a piece of malware or a spam utility. Should we always trust the questioner to use the answer for good? Should we feel obligated to ask the purpose of a question, and how the answer will be used? And how can we prevent answers from being overheard (when asked verbally) or being referenced (when posted publicly online) and then used for unsavory purposes?

  • Usage of Pirated software at a company

    Hi, I am redirected from stack over flow since the topic is ethics rather than about programming. Thank you for letting me know that. and please give me advices. So, I started to work at a company as an engineer a couple of months ago. It's a small company and what they basically do is answering service on phones. Now they are switching from normal phones to IP phones so that computers take more important place in the work. However, all the computers used by workers are equipped with pirated software ,even their operating systems are. Moreover, they don't even buy one license to make copies for other computers. In other words, they do not spend any money for the software in office. I am not saying copying a licensed one is legit, but the situation is too much. There is one guy who did installing those pirated soft. He does not feel any sense of guilt and even justified when I asked about it. and he is not even a specialist. He just searched on the internet to install pirated software. Our boss does not have any knowledge of computers, so he took cheaper way. How do you guys think about this? Since I am still new to the company, I am not doing maintenance or managing on those cracked computers. But I have to use those software daily. And later on I will be doing support, help desk kind of staff. I really don't want to take responsibility for operating pirated software. and from an aspect of developer and engineer, pirated software are not able to get legal support and it may work unexpectedly. So, I am thinking about changing job. Am I thinking too much? should I wait until I have more credit from the boss and try to change his policy? So far, the boss does not take any words from me.   • Signing redistributed files

    In order to submit a desktop application for the Windows 8 app store, you need to digitally sign any driver or .exe associated with the application. However, the application I was trying to submit contains several files that are redistributions of other companies' software, and some of these are not signed. My application was rejected on these grounds. Is it legal (or ethical) to sign other companies' work so that we can submit our application? I think it might be considered some form of false representation but I'm not sure.

  • Is it illegal to rewrite every line of an open source project in a slightly different way, and use it in a closed source project?

    There is some code which is GPL or LGPL that I am considering using for an iPhone project. If I took that code (JavaScript) and rewrote it in a different language for use on the iPhone would that be a legal issue? In theory the process that has happened is that I have gone through each line of the project, learnt what it is doing, and then reimplemented the ideas in a new language. To me it seems this is like learning how to implement something, but then reimplementing it separately from the original licence. Therefore you have only copied the algorithm, which arguably you could have learnt from somewhere else other than the original project. Does the licence cover the specific implementation or the algorithm as well? EDIT------ Really glad to see this topic create a good conversation. To give a bit more backing to the project, the code involved does some kind of audio analysis. I believe it is non-trivial to learn or implement, although I was prepared to embark on this task (I'm at the level where I can implement an FFT algorithm, and this was going to go beyond that.) It is a fairly low LOC script, so I didn't think it would be too hard to do a straight port. I really like the idea of rereleasing my port as well as using it in the application. I don't see any problem with that, and it would be a great way to give something back to the community. I was going to add a line about not wanting to discuss the moral issues, but I'm quite glad I didn't as it seems to have fired the debate a bit. I still feel a bit odd about using open source code to learn from. Does this mean that anything one learns from an open source project is not allowed to be used in a closed source project? And how long after or different does an implementation have to be to not be considered violation of the licence? Murky! EDIT 2 -------- Follow up question

  • How to bill a client for frequently-interrupted time

    I find that when I'm working on hourly-billable projects (in particular, those that are research/design/architecture-oriented as opposed to straight coding) that I'm easily distracted by any number of things (email, grab a drink (loss of focus, but nature happens), link off the webpage I was reading, wandering mind (easy when the job calls for a lot of thinking), etc.) This results in very fragmented time, far too incremental IMO to accurately track with a timeclock, and some time very gray. I frequently end up billing for only some fraction of the elapsed time I spent in order to feel fair, but sometimes it takes a really long time to put in an 8-hour day. By contrast, when I've worked for salary I've not worried about whether I'm actively working at any given minute, I just get the job done, and I've never had anything but stellar reviews/feedback from past salaried employers, so I think I get the job done well. I personally believe in an 80/20 cycle: I get 80% of my work done during an inspired 20% of my time. But I have to screw around the other 80% of the time in order to get that first 20%. So the question: what billing/time-tracking policy can I adopt in order to be fair to my hourly customers without having to write off my own less-productive 80% that a salaried employer is willing to overlook in light of the complete package? Note: This question is not about how to be more productive or focused. It's about how to work around whatever salient limitations that I have in a way that's both fair to me and to my customers. Update: A little clarification (to pre-emptively stop some righteous indignation): I currently have a half dozen different project/client groups. It's not a great situation and I'm working at reducing it down to two, but that's my current reality. It's very easy to get off on a thread related to a different project than the one I'm clocking, and I'm not always conscious of it at the time. [I did not intend the question to mean that I was off playing games or making personal calls, etc., and have adjusted wording above to be clearer. Most of the time. I am only human, and sometimes the mind does force you to take a break! :-)]

    Pagerank algorithm is not revealed to any of their associates programmers, but only accessible by Larry Page or maybe Sergey Brin. I wonder how do they go about managing their coding? There are times when you need to build something up and you may need more hands to help with coding, but you may also want to keep some secrets to yourself, I'm not saying I have secrets, but I wonder how do they manage their coding. I'm sure there are some ways to do it decently and professionally. The reason why friendster failed was because one of the factors they lost control over their coding part. I think this is an interesting question. But not easy to answer, maybe only a marginal knew.

  • Why do we keep using CSV?

    Why do we keep using CSV? I recently made a shift to working the health domain and despite the wonderful work in data transfer standards, all data transfer is in CSV, both for reporting to external organisations, and for data migrations when implementing new systems. Unfortunately the use of CSV is the cause of the endless repetition of the same stupid errors, with the same waste of developer time. (bad escaping, failing to handle null fields etc.) I know we can do better, and anything between JSON and XML (depending on the instance) would be fine. (Most of the time this is data going from one MS SQLserver 2005 to another!) I feel as if each time I see this happening I am literally watching one developer waste anothers time. So why do we keep shafting each other? When will we stop?
