  • Retail in New York - a walk down 5th Avenue

    It's the week of the NRF Big Show and all eyes in the retail industry are on New York. The Big Apple is famous for Big Retail -with a proliferation of incredibly iconic stores. The environment is exciting and familiar even to people visiting this small island for the first time. Most of us have travelled down Fifth Avenue watching movies and TV even if we have never set foot on American soil. I find it one of the most exciting retail cities in the world and I am thrilled this year to be here with so many of Oracle's International retail customers who are joining us for the Retail Exchange. The Oracle program brings retailers from all over the planet together to share ideas and be inspired by New York retail and the NRF event. The show celebrates its 100th year in 2011 and New York itself has been recognized globally as the capital of innovative retail for just as long.  Fifth Avenue is where many global brands have placed their flagship stores, and businesses are in constant competition to set themselves apart from their competitors - both in the store and from the street.  These flag ship retail destinations present what today's customers are finding most exciting and delightful about retail. For the tourist market, they may only visit these stores once, but the impression that a trip to a flagship store leaves with a customer can last a lifetime.  One of the stores that is currently turning heads on Fifth Avenue is Hollister, sister brand to Abercrombie and Fitch, which has filled its shop front with a massive live video (and audio) feed of surfers on the beach in California.  To complete the effect, they also have troughs of water in front of the video screens to bring the sea to the street.  And this isn't the only kind of surfing that retailers are considering today and multi-channel retail is a hot topic that all of the retailers joining the Retail Exchange are considering.   The rest of the world looks to the brands along Fifth Avenue for inspiration - how they take advantage of new opportunities, how they set themselves apart from their competitors and how they keep their products fresh and desirable. With these inspiring pioneers in New York, it's little wonder that NRF's Big Show is so popular, and that New York is viewed as one of the retail capitals of the world.   • Reduce weight in healthy way - Day 2

    My second day of reducing weight and it seems most of the blog are correct in saying that you can reduce weight if your calorie consumption is less than what you burn. In one day I have lost 1 lbs without doing anything. My current weight is 177.4 lbs. Yesterday I ate small portion of dinner that I used to eat that also around 7 PM. Normally I eat my dinner around 10 PM and withing 2 hour of eating I go for sleep, but yesterday I ate around 7 PM and went for sleep only after 12.On my second day I have eaten noodles and 3 eggs in breakfast and sesame chicken ( I love it) and fried rice in lunch, I still have not gone for running but had plan to go for running and then swimming. I hope it will at least burn the calories that I had taken. On some site it was written that a normal men body needs around 2000 Calorie a day. So if I am eating less than 2000 calorie ( noodles + 3 eggs = 400+200, rice + sesame chicken = 1300, total = 1900) and burning around 300 calorie, my total calorie intake will be 1600 which is less than what my body needs. So most probably by tomorrow I should come under 176 lb bracket.Apart from counting the calorie that I am taking in everyday and approx number of calorie that I am burning everyday, I had also starting tracking my physical activities on my mobile. I have got a beautiful Samsung Focus S Windows 7.5 mobile. And after browsing through the market I have downloaded couple of health Apps.1. 6 Week training - this has set of exercise and lets you choose the number of sets you want to do for all exercise. Its focus on your core muscles.2. Fast food Calories - This apps has all the fast food chain listed and give the calorie count of each of the food item available on there menu. Like for Burger King's French Fries Large (Salted) contains 500 Calorie.3. Gym Pocket Guide - Contains instructions for different kind of exercise and tells a right way of doing them.4.  RunSat - kind of GPS based application. Its mark the distance you have run, shows the path you have taken on a map, total calorie burnt, laps completed. I love this apps.5. Stop Watch I also have noticed that If I am running in GYM and have television in front of me where a movie or serial is going on which I like,  I normally didn't notice the time. Most of the time running on treadmill is very boring, but if some music video is playing or some kind of sitcom is going, I can run for  a hour or half.So on day 2 I have lost 1 lbs and had learnt that calorie intake should be less then calorie burnt for a given day.

KLM and Overstock.com are gaining the benefits of Oracle's Customer Service and Support Service from RightNow by better engaging and serving customer needs online and through call centers. And last but not least, Graco and Key Energy are leveraging mobility features and sales forecasting and territory management capabilities within the Oracle Sales and Marketing Service. They expect to gain better visibility to sales information and drive more efficient sales campaigns and empower their sales force with data they need to make sales. Overall, Oracle Apps Cloud Services are enjoying a significant momentum in the marketplace. Steve projected an air of confidence and enthusiasm highlighting Oracle's latest successes with Cloud services.

  • A Bite With No Teeth&ndash;Demystifying Non-Compete Clauses

    *DISCLAIMER: I am not a lawyer and this post in no way should be considered legal advice. I’m also in Canada, so references made are to Canadian court cases. I received a signed letter the other day, a reminder from my previous employer about some clauses associated with my employment and entry into an employee stock purchase program. So since this is in effect for the next 12 months, I guess I’m not starting that new job tomorrow. I’m kidding of course. How outrageous, how presumptuous, pompous, and arrogant that a company – any company – would actually place these conditions upon an employee. And yet, this is not uncommon. Especially in the IT industry, we see time and again similar wording in our employment agreements. But…are these legal? Is there any teeth behind the threat of the bite? Luckily, the answer seems to be ‘No’. I want to highlight two cases that support this. The first is Lyons v. Multari. In a nutshell, Dentist hires younger Dentist to be an associate. In their short, handwritten agreement, a non-compete clause was written stating “Protective Covenant. 3 yrs. – 5mi” (meaning you can’t set up shop within 5 miles for 3 years). Well, the young dentist left and did start an oral surgery office within 5 miles and within 3 years. Off to court they go! The initial judge sided with the older dentist, but on appeal it was overturned. Feel free to read the transcript of the decision here, but let me highlight one portion from section [19]: The general rule in most common law jurisdictions is that non-competition clauses in employment contracts are void. The sections following [19] explain further, and discuss Elsley v. J.G. Collins Insurance Agency Ltd. and its impact on Canadian law in this regard. The second case is Winnipeg Livestock Sales Ltd. v. Plewman. Desmond Plewman is an auctioneer, and worked at Winnipeg Livestock Sales. Part of his employment agreement was that he could not work for a competitor for 18 months if he left the company. Well, he left, and took up an important role in a competing company. The case went to court and as with Lyons v. Multari, the initial judge found in favour of the plaintiffs. Also as in the first case, that was overturned on appeal. Again, read through the transcript of the decision, but consider section [28]: In other words, even though Plewman has a great deal of skill as an auctioneer, Winnipeg Livestock has no proprietary interest in his professional skill and experience, even if they were acquired during his time working for Winnipeg Livestock.  Thus, Winnipeg Livestock has the burden of establishing that it has a legitimate proprietary interest requiring protection.  On this key question there is little evidence before the Court.  The record discloses that part of Plewman’s job was to “mingle with the … crowd” and to telephone customers and prospective customers about future prospects for the sale of livestock.  It may seem reasonable to assume that Winnipeg Livestock has a legitimate proprietary interest in its customer connections; but there is no evidence to indicate that there is any significant degree of “customer loyalty” in the business, as opposed to customers making choices based on other considerations such as cost, availability and the like. So are there any incidents where a non-compete can actually be valid? Yes, and these are considered “exceptional” cases, meaning that the situation meets certain circumstances. Michael Carabash has a great blog series discussing the above mentioned cases as well as the difference between a non-compete and non-solicit agreement. He talks about the exceptional criteria: In summary, the authorities reveal that the following circumstances will generally be relevant in determining whether a case is an “exceptional” one so that a general non-competition clause will be found to be reasonable: - The length of service with the employer. - The amount of personal service to clients. - Whether the employee dealt with clients exclusively, or on a sustained or     recurring basis. - Whether the knowledge about the client which the employee gained was of a   confidential nature, or involved an intimate knowledge of the client’s   particular needs, preferences or idiosyncrasies. - Whether the nature of the employee’s work meant that the employee had   influence over clients in the sense that the clients relied upon the employee’s   advice, or trusted the employee. - If competition by the employee has already occurred, whether there is   evidence that clients have switched their custom to him, especially without   direct solicitation. - The nature of the business with respect to whether personal knowledge of   the clients’ confidential matters is required. - The nature of the business with respect to the strength of customer loyalty,   how clients are “won” and kept, and whether the clientele is a recurring one. - The community involved and whether there were clientele yet to be exploited   by anyone. I close this blog post with a final quote, one from Zvulony & Co’s blog post on this subject. Again, all of this is not official legal advice, but I think we can see what all these sources are pointing towards. To answer my earlier question, there’s no teeth behind the threat of the bite. In light of this list, and the decisions in Lyons and Orlan, it is reasonably certain that in most employment situations a non-competition clause will be ineffective in protecting an employer from a departing employee who wishes to compete in the same business. The Courts have been relatively consistent in their position that if a non-solicitation clause can protect an employer’s interests, then a non-competition clause is probably unreasonable. Employers (or their solicitors) should avoid the inclination to draft restrictive covenants in broad, catch-all language. Or in other words, when drafting a restrictive covenant – take only what you need! D

  • Effectiveness and Efficiency

    In the professional environment, i.e. at work, I am always seeking personal growth and to be challenged. The result is that my assignments, my work list, my tasks, my goals, my commitments, my [insert whatever word resonates with you] keep growing (in scope and desired impact). Which in turn means I have to keep finding new ways to deliver more value, while not falling into the trap of working more hours. To do that I continuously evaluate both my effectiveness and my efficiency. EFFECTIVENESS The first thing I check is my effectiveness: Am I doing the right things? Am I focusing too much on unimportant things? Am I spending more time doing stuff that is important to my team/org/division/business/company, or am I spending it on stuff that is important to me and that I enjoy doing? Am I valuing activities that maybe I have outgrown and should be delegated to others who are at a stage I have surpassed (in Microsoft speak: is the work I am doing level appropriate or am I still operating at the previous level)? Notice how the answers to those questions change over time and due to certain events, so I have to remind myself to revisit them frequently. Events that force me to re-examine them are: change of role, change of team/org/etc, change of direction of team/org/etc, re-org, new hires on the team that take on some of the work I did, personal promotion, change of manager... and if none of those events has occurred since the last annual review, I ask myself those at each annual review anyway. If you think you are not being effective at work, make a list of the stuff that you do and start tracking where your time goes. In parallel, have a discussion with your manager about where they think your time should go. Ultimately your time is finite and hence it is your most precious investment, don't waste it. If your management doesn't value as highly what you spend your time on, then either convince your management, or stop spending your time on it, or find different management: Lead, Follow, or get out of the way! That's my view on effectiveness. You have to fix that before moving to being efficient, or you may end up being very efficient at stuff that nobody wants you to be doing in the first place. For example, you may be spending your time writing blog posts and becoming better and faster at it all the time. If your manager thinks that is not even part of your job description, you are wasting your time to satisfy your inner desires. Nobody can help you with your effectiveness other than your management chain and your management peers - they are the judges of it. EFFICIENCY The second thing I check is my efficiency: Am I doing things right? For me, doing things right means that I deliver the same quality of work faster [than what I used to, and than my peers, and than expected of me]. The result is that I can achieve more [than what I used to, and than my peers, and than expected of me]. Notice how the efficiency goal is a more portable one. If, by whatever criteria, you think you are the best at [insert your own skill here], this can change at two events: because you have new colleagues (who are potentially better than your older ones), and it can change with a change of manager (who has potentially higher expectations). That's about it. Once you are efficient at something, you carry that with you... All you need to really be doing here is, when taking on new kinds of work that you haven't done before, try a few approaches and devise a system so that you can become efficient at this new activity too... Just keep "collecting" stuff that you are efficient at. If you think you are not being efficient at something, break it down: What are the steps you take to complete that task? How long do you spend on each step? Talk to others about what steps they take, to see if you can optimize some steps away or trade them for better steps, or just learn how to complete a step faster. Have a system for every task you take so that you can have repeatable success. That's my view on efficiency. You have to fix it so that you can free up time to do more. When you plan a route from A to B - all else being equal - you try to get there as fast as possible so why would you not want to do that with your everyday work? For example, imagine you are inefficient at processing email: You spend more time than necessary dealing with email, and you still end up with dropped email threads and with slower response times than others. How can you improve? Talk to someone that you think is good at this, understand their system (e.g. here is my email processing system) and come up with one that works for you. Parting Thoughts Are you considered, by your colleagues and manager, an effective and efficient person at your workplace? If you are, what would you change if you were asked by your management to do the job of two people? Seriously, think about that! Your immediate reaction may be "that is not possible", but it actually is. You just have to re-assess what things that were previously important will now stop being important, by discussing them with your management and reaching agreement on relative priorities. For example, stuff that was previously on your plate may now have to be delegated or dropped. Where you thought you were efficient, maybe now you have to find an even faster path to completion, perhaps keeping in mind that Perfect is the Enemy of “Good Enough”. My personal experience (from both observing others and from my own reflection) is that when folks are struggling to keep up at work it is because of two reasons: They are investing energy in stuff that they enjoy doing which the business regards as having a lower priority than a lot of other things on their plate. They are completing tasks to a level of higher quality than what is required (due to personal pride) missing the big picture which almost always mandates completing three tasks at good enough quality than knocking only one of them out of the park while the other two come in late or not at all.   • 3 Reasons You Need To Know Something About Every Technology

    I make my living as a consultant and a general technologist.  I credit my success to the fact that I have never been afraid to pick up any product, language or platform needed to get the job done.  While Microsoft technologies I my mainstay, I have done work on mainframe and UNIX platforms and have worked with a wide variety of database engines.  Each one has it’s use and most times it is less expensive to find a way to communicate with an existing system than to replace it. So what are the main benefits of expending the effort to learn a new technology? New ways to solve problems Accelerate development Advise clients and get new business opportunities By new technology I mean ones that you haven’t had experience with before.  They don’t have to be the the one that just came out yesterday.  As they say, those who do not learn from history are bound to repeat it.  If you can learn something from an older technology it can be just as valuable as the shiny new one.  Either way, when you add another tool to your kit you get a new view on each problem you face.  This makes it easier to create a sound solution. The next thing you can learn from working with different products and techniques is how to more efficiently develop solve problems.  Many times if you are working with a new language you will find that there are specific design patterns that are used with it in normal use.  These can usually be applied with most languages.  You just needed to be exposed to them. The last point is about helping your clients and helping yourself.  If you can get in on technologies early you will have advantage over your competition in the market.  You will also be able to honestly advise you client on why they should or should not go with a new product.  Being able to compare products and their features is always an ability that stake holders appreciate.   • Multiple country-specific domains or one global domain [closed]

    Possible Duplicate: How should I structure my urls for both SEO and localization? My company currently has its main (English) site on a .com domain with a .co.uk alias. In addition, we have separate sites for certain other countries - these are also hosted in the UK but are distinct sites with a country-specific domain names (.de, .fr, .se, .es), and the sites have differing amounts of distinct but overlapping content, For example, the .es site is entirely in Spanish and has a page for every section of the UK site but little else. Whereas the .de site has much more content (but still less than the UK site), in German, and geared towards our business focus in that country. The main point is that the content in the additional sites is a subset of the UK, is translated into the local language, and although sometimes is simply only a translated version of UK content, it is usually 'tweaked' for the local market, and in certain areas, contains unique content. The other sites get a fraction of the traffic of the UK site. This is perfectly understandable since the biggest chunk of work comes from the UK, and we've been established here for over 30 years. However, we are wanting to build up our overseas business and part of that is building up our websites to support this. The Question: I posed a suggestion to the business that we might consider consolidating all our websites onto the .com domain but with /en/de/fr/se/etc sections, as plenty of other companies seem to do. The theory was that the non-english sites would benefit from the greater reputation of the parent .com domain, and that all the content would be mutually supporting - my fear is that the child domains on their own are too small to compete on their own compared to competitors who are established in these countries. Speaking to an SEO consultant from my hosting company, he feels that this move would have some benefit (for the reasons mentioned), but they would likely be significantly outweighed by the loss of the benefits of localised domains. Specifically, he said that since the Panda update, and particularly the two sets of changes this year, that we would lose more than we would gain. Having done some Panda research since, I've had my eyes opened on many issues, but curiously I haven't come across much that mentions localised domain names, though I do question whether Google would see it as duplicated content. It's not that I disagree with the consultant, I just want to know more before I make recommendations to my company. What is the prevailing opinion in this case? Would I gain anything from consolidating country-specific content onto one domain? Would Google see this as duplicate content? Would there be an even greater penalty from the loss of country-specific domains? And is there anything else I can do to help support the smaller, country-specific domains?

  • Testing Workflows &ndash; Test-First

    Originally posted on: http://geekswithblogs.net/TimothyK/archive/2014/05/30/testing-workflows-ndash-test-first.aspxThis is the second of two posts on some common strategies for approaching the job of writing tests.  The previous post covered test-after workflows where as this will focus on test-first.  Each workflow presented is a method of attack for adding tests to a project.  The more tools in your tool belt the better.  So here is a partial list of some test-first methodologies. Ping Pong Ping Pong is a methodology commonly used in pair programing.  One developer will write a new failing test.  Then they hand the keyboard to their partner.  The partner writes the production code to get the test passing.  The partner then writes the next test before passing the keyboard back to the original developer. The reasoning behind this testing methodology is to facilitate pair programming.  That is to say that this testing methodology shares all the benefits of pair programming, including ensuring multiple team members are familiar with the code base (i.e. low bus number). Test Blazer Test Blazing, in some respects, is also a pairing strategy.  The developers don’t work side by side on the same task at the same time.  Instead one developer is dedicated to writing tests at their own desk.  They write failing test after failing test, never touching the production code.  With these tests they are defining the specification for the system.  The developer most familiar with the specifications would be assigned this task. The next day or later in the same day another developer fetches the latest test suite.  Their job is to write the production code to get those tests passing.  Once all the tests pass they fetch from source control the latest version of the test project to get the newer tests. This methodology has some of the benefits of pair programming, namely lowering the bus number.  This can be good way adding an extra developer to a project without slowing it down too much.  The production coder isn’t slowed down writing tests.  The tests are in another project from the production code, so there shouldn’t be any merge conflicts despite two developers working on the same solution. This methodology is also a good test for the tests.  Can another developer figure out what system should do just by reading the tests?  This question will be answered as the production coder works there way through the test blazer’s tests. Test Driven Development (TDD) TDD is a highly disciplined practice that calls for a new test and an new production code to be written every few minutes.  There are strict rules for when you should be writing test or production code.  You start by writing a failing (red) test, then write the simplest production code possible to get the code working (green), then you clean up the code (refactor).  This is known as the red-green-refactor cycle. The goal of TDD isn’t the creation of a suite of tests, however that is an advantageous side effect.  The real goal of TDD is to follow a practice that yields a better design.  The practice is meant to push the design toward small, decoupled, modularized components.  This is generally considered a better design that large, highly coupled ball of mud. TDD accomplishes this through the refactoring cycle.  Refactoring is only possible to do safely when tests are in place.  In order to use TDD developers must be trained in how to look for and repair code smells in the system.  Through repairing these sections of smelly code (i.e. a refactoring) the design of the system emerges. For further information on TDD, I highly recommend the series “Is TDD Dead?”.  It discusses its pros and cons and when it is best used. Acceptance Test Driven Development (ATDD) Whereas TDD focuses on small unit tests that concentrate on a small piece of the system, Acceptance Tests focuses on the larger integrated environment.  Acceptance Tests usually correspond to user stories, which come directly from the customer. The unit tests focus on the inputs and outputs of smaller parts of the system, which are too low level to be of interest to the customer. ATDD generally uses the same tools as TDD.  However, ATDD uses fewer mocks and test doubles than TDD. ATDD often complements TDD; they aren’t competing methods.  A full test suite will usually consist of a large number of unit (created via TDD) tests and a smaller number of acceptance tests. Behaviour Driven Development (BDD) BDD is more about audience than workflow.  BDD pushes the testing realm out towards the client.  Developers, managers and the client all work together to define the tests. Typically different tooling is used for BDD than acceptance and unit testing.  This is done because the audience is not just developers.  Tools using the Gherkin family of languages allow for test scenarios to be described in an English format.  Other tools such as MSpec or FitNesse also strive for highly readable behaviour driven test suites. Because these tests are public facing (viewable by people outside the development team), the terminology usually changes.  You can’t get away with the same technobabble you can with unit tests written in a programming language that only developers understand.  For starters, they usually aren’t called tests.  Usually they’re called “examples”, “behaviours”, “scenarios”, or “specifications”. This may seem like a very subtle difference, but I’ve seen this small terminology change have a huge impact on the acceptance of the process.  Many people have a bias that testing is something that comes at the end of a project.  When you say we need to define the tests at the start of the project many people will immediately give that a lower priority on the project schedule.  But if you say we need to define the specification or behaviour of the system before we can start, you’ll get more cooperation.   Keep these test-first and test-after workflows in your tool belt.  With them you’ll be able to find new opportunities to apply them.

  • SharePoint Thoughts

    I was listening to .NET Rocks episode #713 and it got me thinking about a number of SharePoint related topics. I have been working with SharePoint since the 2001 product came out and have watched it evolve over the years.  Today SharePoint is one of the most powerful and flexible products in the market.  Of course that doesn’t mean there isn’t room for improvement (a lot of improvement in fact) and with much power comes much responsibility. My main gripe these days is that you have to develop on a server instance.  This adds a real barrier to entry for developers.  You either have to run VMWare or Hyper-V on your developer machine or actually develop on your dev server for most tasks.  Yes, there is a way to setup a Windows 7 machine with the SharePoint components but it is very hackish. Beyond that the tools in VS2010 are a great leap forward from past generations.  Not requiring a separate package creation tool is not the least of the improvements.  Better workflow and web part development have also eased the burden of many developers. The other thing the show brought up in my thoughts was more around usage.  Users want to be able to self server everything without regard to what affect that has on leveraging their data from a corporate perspective.  My coworkers who work on Lotus Notes ask why the user can’t just do what ever they want? Part of the reason is that those features have not been built, but the other part is that giving them those features is often like giving an infant a loaded hand gun.  You can do it but it doesn’t make it the smart thing to do. As with any tool that is going to be used in the enterprise it should be subject to governance.  If controls are not in place as they said in the episode of DNR the document libraries and I believe SharePoint in general starts to look as disarrayed and unusable as a shared drive.  Consider these factors before giving into every whim of the users.  You should be able to explain to them the tradeoffs of giving them full control versus being able to leverage the information they collect to the benefit of the organization.   • The State of the Internet -- Retail Edition

    Over at Business Insider, there's a great presentation on the State of the Internet done in the Mary Meeker style.  Its 138 slides so I took the liberty of condensing it down to the 15 slides that directly apply to the retail industry.  However, I strongly recommend looking at the entire deck when you have time.  And while you're at it, Business Insider just launched a retail portal that's dedicated to retail industry content.  Please check it out as well.  My take-aways are below after the slide show. &amp;amp;amp;amp;lt;span id=&amp;amp;amp;amp;quot;XinhaEditingPostion&amp;amp;amp;amp;quot;&amp;amp;amp;amp;gt;&amp;amp;amp;amp;lt;/span&amp;amp;amp;amp;gt; [Source: Business Insider] Here are a few things I took away from the statistics: Facebook and Twitter are in their infancy.  While all retailers should have social programs, search is still the driver and therefore should receive the lions share of investment.  Facebook referrals are up 92% year-over-year, but Google still does 80% of the referrals. E-commerce continues to grow at breakneck speed, but in-store commerce is still king. Stores are not showrooms yet.  And social commerce pure-plays like Gilt and Groupon are tiny but worthy of some attention. There are more smartphones than PCs on the internet, and the disparity will continue to grow. PC growth will be flat and Tablet use will continue to grow. Mobile accounts for 12% of all internet traffic. A quarter of smartphone sales come from China, so anyone with a presence there better have a strong mobile strategy. 38% of people have used their smartphone to make a purchase, and many use their smartphones inside stores.  Smartphones are a critical consumer tool for shopping. Mobile is starting to drive significant traffic to e-commerce sites, especially tablets.  Tablet strategies are crucial for retailers. Mobile payments from the likes of Paypal and Square are growing quickly.  It will be interesting to see how NFC plays in this area. Mobile operating systems are losing market share to iOS and Android.  I wonder in Microsoft can finally make a dent? The internet is being dominated by mobile devices, and retailers had better have a strong mobile strategy to meet consumer demand.

  • Looking for an ultra portable laptop for Ubuntu

    Hi, I'm in the market for a new laptop, and portability is important since I really only use it when I'm travelling to and from work - primarily for programming. I've been searching high and low for something like this: less than 2kg hopefully Intel i5 (but negotiable) NO dvd drive - just don't need it 4G ram either 7200rpm disk or SSD (ssd preferable) 13 inch screen not too pricey (MacBook Air is about $1700 AUD) available in Australia The Dell Inspiron 13z and Lenovo Edge 13 look close, but I've not found anything that says I'm not going to have a fight with compatibility. The MacBook Air 13 looks like the PERFECT hardware, but I'm afraid it will just be easier to run MacOS than Ubuntu. I want to stay with Ubuntu, but the MacBook Air is only $1700 so I'm in danger of becoming another apple fanboi if I can't find anything competitive. Going through all the sites looking for stuff has been a huge waste of time System 76 doesn't deliver to Australia http://www.linux-laptop.net/ and http://www.linlap.com/ are hard work and not confidence inspiring http://www.vgcomputing.com.au/nsintro.html is hard work again, searching for every laptop they say has excellent compatibility on the web to find out what spec it is http://zareason.com/shop/Strata-Pro-13.html (at $1345 USD) looks interesting, but I've got no idea how much I'll get stung by customs importing Dell Inspiron 13z with i5, 4G, 320 7200rpm disk, ATI Mobility Radeon HD5430 - 1GB, Dell Wireless 1501 802.11b/g/n @ $1200 AUD seems like the only competitor but is it compatible? (Dell support offer no opinion - as far as they are concerned they only have 2 models that are certified for ubuntu) Am I worrying too much about the compatibility? Should I just go with Dell? Or switch to MacOS? (It would be good to have a searchable database that had the full machine specs, and compatibility - I'm thinking about building something... but I don't have much time right now...) Thanks. UPDATE I went with a MacBook Air. The price/weight/power was just right. Everything else was either too pricy (i5) or too heavy, or underpowered (SU7300 1.3GHz). Its a pity, because I didn't really want to leave Ubuntu. I'll still run it on my media center and spare (heavy) laptop.

  • How to manage a Closed Source High-Risk Project?

    I am currently planning to develop a J2EE website and wish to bring in 1 developer and 1 web designer to assist me. The project is a financial app with a niche market. I plan to keep the source closed . However, I fear that my would-be employees could easily copy the codebase and use it /sell it to a third party especially when they switch jobs. The app development will take 4-6months and perhaps more and I may have to bring in people after the app goes live. How do I keep the source to myself. Are there techniques companies use to guard their source. I foresee disabling pendrives and dvd writers on my development machines, but uploading data or attaching the code in one's mail would still be possible. My question is incomplete. But programmers who have been in my situation, please advice. How should I go about this? Building a team, maintaining code-secrecy,etc. I am looking forward to sign a secrecy contract with the employees if needed too. (Please add relevant tags) Update Thank you for all the answers. I certainly won't be disabling all USB ports and DVD writers now. But I think I should be logging activity(How exactly should I do that?) I am wary of scalpers who would join and then run off with the existing code. I haven't met any, but I have been advised to be wary of them. I would include a secrecy clause, but given this is a startup with almost no funding and in a highly competitive business niche with bigger players in the field, I doubt I would be able to detect or pursue any scalpers. How do I hire people I trust, when I don't know them personally. Their resume will be helpful but otherwise trust will develop only with time. But finally even if they do run away with the code, it is service that matters after the sale is made. So I am not really worried for the long term.

  • Microsoft and Application Architectures

    Microsoft has dealt with several kinds of application architectures to include but not limited to desktop applications, web applications, operating systems, relational database systems, windows services, and web services. Because of the size and market share of Microsoft, virtually every modern language works with or around a Microsoft product. Some of the languages include: Visual Basic, VB.Net, C#, C++, C, ASP.net, ASP, HTML, CSS, JavaScript, Java and XML. From my experience, Microsoft strives to maintain an n-tier application standard where an application is comprised of multiple layers that perform specific functions, for example: presentation layer, business layer, data access layer are three general layers that just about every formally structured application contains. The presentation layer contains anything to do with displaying information to the screen and how it appears on the screen. The business layer is the middle man between the presentation layer and data access layer and transforms data from the data access layer in to useable information to be stored later or sent to an output device through the presentation layer. The data access layer does as its name implies, it allows the business layer to access data from a data source like MS SQL Server, XML, or another data source. One of my favorite technologies that Microsoft has come out with recently is the .Net Framework. This framework allows developers to code an application in multiple languages and compiles them in to one intermediate language called the Common Language Runtime (CLR). This allows VB and C# developers to work seamlessly together as if they were working in the same project. The only real disadvantage to using the .Net Framework is that it only natively runs on Microsoft operating systems. However, Microsoft does control a majority of the operating systems currently installed on modern computers and servers, especially with personal home computers. Given that the Microsoft .Net Framework is so flexible it is an ideal for business to develop applications around it as long as they wanted to commit to using Microsoft technologies and operating systems in the future. I have been a professional developer for about 9+ years now and have seen the .net framework work flawlessly in just about every instance I have used it. In addition, I have used it to develop web applications, mobile phone applications, desktop applications, web service applications, and windows service applications to name a few.

    I read a very interesting article called Seven Accounting Changes That Will Affect Your 2010 Annual Report from SmartPros that nicely summarized how 2010 annual financial statements will be impacted.  Here’s a Reader’s Digest version of the changes: 1.  Changes to revenue recognition if you sell bundled products with multiple deliverables: Old Rule: You needed to objectively establish the “fair value” of each bundled item. So if you sold a dishwasher plus installation and could not establish the fair value of the installation, you might have to delay recognizing revenue of the dishwasher days or weeks later until it was installed. New Rule (ASU 2009-13): “Objective” proof of each service or good is no longer required; you can simply estimate the selling price of the installation and warranty. So the dishwasher vendor can recognize the dishwasher revenue immediately at the point of sale without waiting a few weeks for the installation. Then they can recognize the estimated value of the installation after it is complete. 2.  Changes to revenue recognition for devices with embedded software: Old Rule: Hardware devices with embedded software, such as the iPhone, had to follow stringent software revrec rules. This forced Apple to recognize iPhone revenues over two years, the period of time that software updates were provided. New Rule (ASU 2009-14): Software revrec rules no longer apply to these devices with embedded software; these devices can now follow ASU 2009-13. This allows vendors, such as Apple, to recognize revenue sooner. 3.  Fair value disclosures: Companies (both public and private) now need to spend extra time gathering, summarizing, and disclosing information about items measured at fair value, such as significant transfers in and out of Level 1(quoted market price), Level 2 (valuation based on observable markets), and Level 3 (valuations based on internal information). 4.  Consolidation of variable interest entities (a.k.a special purpose entities): Consolidation rules for variable interest entities now require a qualitative, not quantitative, analysis to determine the primary beneficiary. Instead of simply looking at the percentage of voting interests, the primary beneficiary could have less than the majority interests as long as it has the power to direct the activities and absorb any losses.  5.  XBRL: Starting in June 2011, all U.S. public companies are required to file financial statements to the SEC using XBRL. Note: Oracle supports XBRL reporting. 6.  Non-GAAP financial disclosures: Companies that report non-GAAP measures of performance, such as EBITDA in SEC filings, have more flexibility.  The new interpretations can be found here: http://www.sec.gov/divisions/corpfin/guidance/nongaapinterp.htm.  7.  Loss contingencies disclosures: Companies should expect additional scrutiny of their loss disclosures, such as those from litigation losses, in their annual financial statements. The SEC wants more disclosures about loss contingencies sooner instead of after the cases are settled.

  • Cloud Infrastructure has a new standard

    I have been working for more than two years now in the DMTF working group tasked with creating a Cloud Management standard. That work has culminated in the release today of the Cloud Infrastructure Management Interface (CIMI) version 1.0 by the DMTF. CIMI is a single interface that a cloud consumer can use to manage their cloud infrastructure in multiple clouds. As CIMI is adopted by the cloud vendors, no more will you need to adapt client code to each of the proprietary interfaces from these multiple vendors. Unlike a de facto standard where typically one vendor has change control over the interface, and everyone else has to reverse engineer the inner workings of it, CIMI is a de jure standard that is under change control of a standards body. One reason the standard took two years to create is that we factored in use cases, requirements and contributed APIs from multiple vendors. These vendors have products shipping today and as a result CIMI has a strong foundation in real world experience. What does CIMI allow? CIMI is both a model for the resources (computing, storage networking) in the cloud as well as a RESTful protocol binding to HTTP. This means that to create a Machine (guest VM) for example, the client creates a “document” that represents the Machine resource and sends it to the server using HTTP. CIMI allows the resources to be encoded in either JavaScript Object Notation (JSON) or the eXentsible Markup Language (XML). CIMI provides a model for the resources that can be mapped to any existing cloud infrastructure offering on the market. There are some features in CIMI that may not be supported by every cloud, but CIMI also supports the discovery of which features are implemented. This means that you can still have a client that works across multiple clouds and is able to take full advantage of the features in each of them. Isn’t it too early for a standard? A key feature of a successful standard is that it allows for compatible extensions to occur within the core framework of the interface itself. CIMI’s feature discovery (through metadata) is used to convey to the client that additional features that may be vendor specific have been implemented. As multiple vendors implement such features, they become candidates to add the future versions of CIMI. Thus innovation can continue in the cloud space without being slowed down by a lowest common denominator type of specification. Since CIMI was developed in the open by dozens of stakeholders who are already implementing infrastructure clouds, I expect to CIMI being adopted by these same companies and others over the next year or two. Cloud Customers who can see the benefit of this standard should start to ask their cloud vendors to show a CIMI implementation in their roadmap.  For more information on CIMI and the DMTF's other cloud efforts, go to: http://dmtf.org/cloud
