• What's your advise on a potential legal suit? [closed]

  I [xxx app developer] received an email from Apple that a developer [of yyy app] believes I am "infringing their copyright." Description of Issue: [xxx developer] copied my application (my application is [yyy]) feature by feature. Even their donation model is completely copied from my application. Their first release was significantly later than mine, which implies copying of the application rather than parallel development. I suffered significant financial losses because of their actions, in additional to promotion problems as many people are confused with their product. My advertising was based around the idea of a "free [yyy] application for an iPhone" and they have just taken that as a title for their application. I would appreciate if someone takes a look at their release schedule and compare it to my releases. Additionally, please take a look at their functionality and how it point by point copies the functionality of my older releases. I am asking Apple to remove their application from the App Store, and ban them from resubmitting it. Thank you for your time! [yyy developer], the developer of the [yyy] application. My response was: The code of [xxx] is written by myself, using Apple public API. The graphics elements are designed by myself. The user interface and app control are independently designed and different from other [similar type] apps (please judge yourself). In-app Purchase is iOS Apple standard API. iAd is Apple iOS standard API. I don't think features can be owned exclusively. In fact, my app comes with fewer features, as I prefer minimalist design. I don't think idea can be owned exclusively. Apple responded: Thank you for your response. Unfortunately, Apple cannot serve as arbiter for disputes among third parties. Please contact [yyy developer] directly regarding your actions. You can reach [yyy developer] through: [...]. We look forward to confirmation from both parties that this issue has been resolved. If this issue is not resolved shortly, Apple may be forced to pull your application(s) from the App Store. Then I sent my response above to [yyy developer]. [yyy developer] then asked me "to provide (my) legal address and contact details that (his) lawyer requires to file a copyright infringement suit." IMO, I don't think the [yyy developer]'s claim on "feature by feature" copy is valid. I have fewer features, completely different user interface design. However, I don't think I can afford a legal action for an app of so little financial return. So what's your advise on this? Should I just let Apple pull my app? • Oracle ERP Cloud Solution Defines Revenue Recognition Software Market

  Normal 0 false false false EN-US X-NONE X-NONE Revenue is a fundamental yardstick of a company's performance, and one of the most important metrics for investors in the capital markets. So it’s no surprise that the accounting standard boards have devoted significant resources to this topic, with a key goal of ensuring that companies use a consistent method of recognizing revenue. Due to the myriad of revenue-generating transactions, and the divergent ways organizations recognize revenue today, the IFRS and FASB have been working for 12 years on a common set of accounting standards that apply to all industries in virtually all countries. Through their joint efforts on May 28, 2014 the FASB and IFRS released the IFRS 15 / ASU 2014-9 (Revenue from Contracts with Customers) converged accounting standard. This standard applies to revenue in all public companies, but heavily impacts organizations in any industry that might have complex sales contracts with multiple distinct deliverables (obligations). For example, an auto dealer who bundles free service with the sale of a car can only recognize the service revenue once the owner of the car brings it in for work. Similarly, high-tech companies that bundle software licenses, consulting, and support services on a sales contract will recognize bundled service revenue once the services are delivered. Now all companies need to review their revenue for hidden bundling and implicit obligations. Numerous time-consuming and judgmental activities must be performed to properly recognize revenue for complex sales contracts. To illustrate, after the contract is identified, organizations must identify and examine the distinct deliverables, determine the estimated selling price (ESP) for each deliverable, then allocate the total contract price to each deliverable based on the ESPs. In terms of accounting, organizations must determine whether the goods or services have been delivered or performed to the customer’s satisfaction, then either book revenue in the current period or record a liability for the obligation if revenue will be recognized in a future accounting period. Oracle Revenue Management Cloud was architected and developed so organizations can simplify and streamline revenue recognition. Among other capabilities, the solution uses business rules to efficiently identify and examine contracts, intelligently calculate and allocate deliverable prices based on prescribed inputs, and accurately recognize revenue for each deliverable based on customer satisfaction. • iOS - pass UIImage to shader as texture

  I am trying to pass UIImage to GLSL shader. When I just send data from camera, everything is fine. So problem should be with sending another texture to shader. • The Oracle Cash Management Secret Very Few Customers Know About

  Did you know that Oracle Cash Management has a robust positioning feature? I had no idea. I was under the mistaken impression that Oracle Cash Management only did bank statement reconciliations. It seems I am not alone. In fact, many Oracle Financials customers are also not aware of this even though it is delivered for free with the Oracle Financials license. Even better, last week, Oracle released an enhancement to Oracle Cash Management for Release 12 that will greatly help customers with their cash positioning needs. As we all know, credit is tight these days. Companies need better visibility of their cash and other liquidity positions to make better use of their cash resources. Today, many customers are managing their cash positions manually using spreadsheets. We also hear how many of them are maintaining larger than normal balances in numerous bank accounts because they just do not have the visibility, and therefore the comfort they need. Although spreadsheets may work in the short-term, they are not the best way to manage your cash positions for the long-term especially if you have dozens, or even hundreds of bank and brokerage accounts. Also, spreadsheets are a lot more risky because they can be overwritten, deleted, difficult to audit, etc. With the newly enhanced positioning feature in Oracle Cash Management, customers can manage their daily cash positions using an excel-like interface that is very flexible and user-configurable. You can link the worksheet to an unlimited number of bank accounts to automatically retrieve your opening balances, the current/intra-day cash inflows and outflows, as well as your expected cash flows from your Fx, Investment and Debt positions if you have Oracle's Treasury module . Oracle Cash Management also has direct integration with Oracle Receivables, Oracle Payables, and Payroll, which adds to the comprehensive picture of what's happening with your organizations' cash in real-time. • Help for choosing a cost effective game server for Flash client

  I am developing a flash-based game primarily for desktops, to be hosted on facebook platform (like cityville, sims social etc). The gameplay doesn't involve real-time communication between players unlike an mmorpg. Here each player plays in his own world without any knowledge of other online players. I've written almost 95% of the game logic in actionscript on the client side. I used Smartfox Server pro on the server side (mostly used for getting data from the DB) and the entire server code is an extension written in java. I'm using json as the protocol for communication. Although I love smartfox server, as an indie, its tough for me to afford the unlimited users license. Morever its limited just to one machine. So I'm looking for an alternative to smartfox server now. The reason for choosing smartfox server earlier was to use the server properties supported by it. Server properties on smartfox server take advantage of the socket connection and are essentially server side objects in java which store some data for the player which he can change frequently during the game. And when he logs out of the game, the extension can write out the final state in the DB (I'm using MySQL). This significantly reduces the number of DB UPDATE/INSERT calls made during the game. I love the way this works since the data is secure as its on the server side and smartfox server is known to be scalable. (although I'm not sure whether this approach is used widely by gaming industry or not, since this is not an mmorpg, I'm putting all player in the lobby). So my question is whether any of the free and community supported servers like reddwarf, firebase, BlazeDS etc can provide a similar architecture so that I can use server properties without many code changes? EDIT : I am not insisting on the exact same feature (thats asking too much!), but atleast a viable messaging system on the server so that I can send actionscript objects from the client using json/binary so that its fast. • Do I need to contact a lawyer to report a GPL violation in software distributed on Apple's App Store?

  Some company is selling software through Apple's App Store which uses portions of code that I released publicly under the GPL. The company is violating the licensing terms in two ways, by (1) not preserving my copyright statement, and not releasing their code under the GPL license and (2) by distributing my GPL-licensed code through Apple's App Store. (The Free Software Foundation has made clear that the terms of the GPL and those of the App Store are incompatible.) I want to report this to Apple, and ask that they take appropriate action. I have tried mailing them to ask for more information about the reporting process, and have received the automated reply quoted below. The last point in the list of things one needs to provide, the “a statement by you, made under penalty of perjury,” sounds as if they mean some kind of specific legal document. I'm not sure. Does this mean I need to contact a lawyer just to file the report? I'd like to avoid going through that hassle if at all possible. (Besides an answer to this specific question, I'd welcome comments and experience reports from anyone who has already had to deal with a GPL violation on Apple's App Store.) • Visual Studio 2010 plus Help Index : have your cake and eat it too

  Although the team's intentions might have been good, the new help system in Visual Studio 2010  is a huge step backwards (more like a cannonball-shot-kind-of-leap really) from the one we all know (and love?) in Visual Studio 2008 and 2005 (and heck, even VS6). Its biggest problem, from my point of view, is the total and complete lack of the Help Index feature: you know...the thing where you just go and type in what you're looking for and it filters down the list of results automatically. For me this was the number one productivity feature in the "old" help system, allowing me to find stuff very quickly. Number two is that it's entirely web based and runs, by default, in the browser. So imagine, when you press F1, a new tab opens in your default browser pointing to the help entry. While this is wrong in many ways, it's also extremely annoying, cleaning up tabs in the browser becomes a chore which represents a serious productivity hit. These and many other problems were discussed extensively (and rather vocally) on connect but it seems MS seemed to ignore it and opt to release the new help system anyway, with the promise that more features will be added in a later release. Again, it kind of amazes me that they chose to ship a product with LESS features that the previous one and, what's worse, missing KEY features, just so it's "standards based" and "extensible". To be honest, I couldn't care less about the help system's implementation, I just want it to be usable and I would've thought that by now the software community and especially MS would've learned this lesson. In the end, what kind of saddens me is that MS regards these basic features as ones for the "power help user". I mean, come on! I mean a) it's not like my aunt's using Visual Studio 2010 and she represents the regular user, b) all software developers are, by definition, power users and c) it's a freakin help, not rocket science! As you can tell, I'm pretty pissed. Even more so because I really feel that the VS2010 & co. release really is a great one, with a lot of effort going into the various platforms and frameworks, most (if not all) of them being really REALLY good products. And then they go and screw up the help! How lame is that?!   Anyway, it's not all gloom-and-doom. Luckily there is a desktop app which presents a UI over the new help system that's very close to what was there in VS2008, by Robert Chandler (to which I hereby declare eternal gratitude). It still has some minor issues but I'll take it over the browser version of the help any day. It's free, pretty quick (on my machine ;)) and nicely usable. So, if you hate the new help system (passionately) like I do, download H3Viewer now.

• Six Unusual Blogs I Like

  I subscribe to and read over 100 SQL Server blogs every day.  I link to posts that I think are interesting.  I also read a fair number of non-SQL Server blogs.  Here are a few that I think are interesting. danah boyd. She is a researcher with Microsoft and writes about privacy, social media and teenagers.  I discovered her blog while looking for strategies to keep my personal and professional life separate.  (I haven’t found a good solution to that yet.)  Her stories of how teenagers use Facebook and other social media tools are fascinating. Clayton’s Web Snacks.  Steve Clayton works at Microsoft and has a variety of blogs out there.  This one focuses on … hmmm.  His latest posts are on graffiti, infographics, paper tweets, cartoons and slow motion videos.  It’s mostly visual and you never really know what you’ll get.  It’s always interesting though and I like what he posts.  It’s good creative stuff. Seth Godin.  Seth writes about Marketing.  I read him for motivation to get off my butt and get things done.  He’s a great motivator who encourages you to think big.  And do something! Ask the Pilot.  Patrick Smith is a commercial airline pilot writing about the airline industry.  He’s a great debunker of myths (no they don’t reduce oxygen in the cabin to keep you docile).  My favorite topics include the TSA, flying myths, airport reviews and flight delays. My old favorite flight blog used to be enplaned.  No one knew who wrote it.  It focused on the economics of the airline industry.  It was fascinating stuff.  One day it was gone.  The entire blog was deleted.  Someone tracked down some partial archives and put them online. The Agent’s Journal.  Jack Bechta is an NFL agent.  He writes about the business side of the NFL, the draft and free agency.  Lately he’s been writing about the potential lockout.  He has a distinct lack of hype which I find very refreshing.  xkcd.  I call this the comic for smart people.  A little math, some IT and internet privacy thrown in all make an unusual comic. Funny and intelligent.

Templates are available for: E-Business Suite 12.1.3 Vision (64-bit) E-Business Suite 12.1.3 Production (32-bit) E-Business Suite 12.x Sparse Middle Tiers (32-bit and 64-bit) Thanks Steven! Why does this stuff matter? Well, in general, virtualization (or cloud) solutions provide an easy way to create Virtual Machines. Whether it's through a "cloud api" or just a virtualization API. But all you end up with, in the end, is still just a Virtual Machine... Maybe with an OS pre-installed/pre-configured. So you have flexibility of moving VMs around and providing a VM but what about the actual applications (anything more than a very basic app)? The application administrator then still has to go and install and configure the OS for that application and install the application and its patches and basic configuration so that the application user then can go in. Building gold images for complex software stacks that are not owned by the users/admins is always very difficult. With our templates, we provide a number of things : Oracle Linux pre-installed and pre-configured with the minimum required packages for that application to run. (so it's secure) Oracle Linux can be distributed and used for free or with a support subscription. There is no trial license, there is no registration key, no alpha version or community version versus enterprise version. You get what we provide in our engineered systems, what we provide support for, without change. Supported out of the box. No virtual Trial appliances, no prototypes, no POC. What you download is production ready without change. The applications are installed by the developers of the application. The database team builds database templates, the applications engineering team builds applications templates. The first boot/configuration scripts ask for the basic information such as hostname, ip address, user passwords and then go off and set everything up correctly. All tested together - application - operating system - hypervisor. not 3 (or more) products from 3(or more) different companies.

BizSpark Tampa Bay:  I run a BizSpark group for Microsoft technologists (meetup.com, search for BizSpark Tampa Bay) and speak at Code Camps about "No Better Time to Start Your Own Tech Business".  The meetup group facilitates a balanced presentation that is respectful to anyone wanting to start their own business, whether part-time or full-time, whether micro (just you), sustainable (grow to 2-25-ish, self-funded), high growth (get venture capital or other funding, grow it, sell it within 5 years, do it again), or hybrid (the new model going forward).  It is an "action" group, with assignments and homework if you want to get the most out of it.   At the end of a year you will either have your business on the path to where you want it to be, or you will know the steps you need to do to get it there. Women in Technology Have been participating in the Women in Technology community since 2008, my main interests in this area are mentoring women in the workplace to have them believe they can become geeks and double their income, and to mentor them with respect to starting and running their own business. My day job is Environmental, Health & Safetey (EHS) consulting and software solutions, where that interfaces with the developer world is with respect to opportunities around Green and Sustainability, The SmartGrid and Juval Lowy's EnergyNet, both of which will require a lot of technology and software to make them work, The new Microsoft Partner competency for "Digital Home", and The Y2K kind of deadline around how managing chemicals in ERP systems is changing because of Global Harmonization, which hits the EU with a hard deadline on 11/30/10 (yes, this year), and hits the USA about 15 months later. • ODI 11g - Dynamic and Flexible Code Generation

  ODI supports conditional branching at execution time in its code generation framework. This is a little used, little known, but very powerful capability - this let's one piece of template code behave dynamically based on a runtime variable's value for example. Generally knowledge module's are free of any variable dependency. Using variable's within a knowledge module for this kind of dynamic capability is a valid use case - definitely in the highly specialized area. The example I will illustrate is much simpler - how to define a filter (based on mapping here) that may or may not be included depending on whether at runtime a certain value is defined for a variable. I define a variable V_COND, if I set this variable's value to 1, then I will include the filter condition 'EMP.SAL > 1' otherwise I will just use '1=1' as the filter condition. I use ODIs substitution tags using a special tag '<$' which is processed just prior to execution in the runtime code - so this code is included in the ODI scenario code and it is processed after variables are substituted (unlike the '<?' tag).  So the lines below are not equal ... <$ if ( "#V_COND".equals("1")  ) { $> EMP.SAL > 1 <$ } else { $> 1 = 1 <$ } $> <? if ( "#V_COND".equals("1")  ) { ?> EMP.SAL > 1 <? } else { ?> 1 = 1 <? } ?> When the <? code is evaluated the code is executed without variable substitution - so we do not get the desired semantics, must use the <$ code. You can see the jython (java) code in red is the conditional if statement that drives whether the 'EMP.SAL > 1' or '1=1' is included in the generated code. For this illustration you need at least the ODI 11.1.1.6 release - with the vanilla 11.1.1.5 release it didn't work for me (may be patches?). As I mentioned, normally KMs don't have dependencies on variables - since any users must then have these variables defined etc. but it does afford a lot of runtime flexibility if such capabilities are required - something to keep in mind, definitely.

• SQL SERVER – Validating Spatial Object with IsValidDetailed Function

  What do you prefer – error or warning indicating error may happen with the reason for the error. While writing the previous statement I remember the movie “Minory Report”. This blog post is not about minority report but I will still cover the concept in a single statement “Let us predict the future and prevent the crime which is about to happen in future”. (Please feel free to correct me if I am wrong about the movie concept, I really do not want to hurt your sentiment if you are dedicated fan). Let us switch to the SQL Server world. Spatial data types are interesting concepts. I love writing about spatial data types because it allows me to be creative with shapes (just like toddlers). When working with Spatial Datatypes it is all good when the spatial object works fine. However, when the spatial object has issue or it is created with invalid coordinates it used to give a simple error that there is an issue with the object but did not provide much information. This made it very difficult to debug. If this spatial object was used in the big procedure and while this big procedural error out because of the invalid spatial object, it is indeed very difficult to debug it. I always wished that the more information provided regarding what is the problem with spatial datatype. SQL Server 2012 has introduced the new function IsValidDetailed(). This function has made my life very easy. In simple words this function will check if the spatial object passed is valid or not. If it is valid it will give information that it is valid. If the spatial object is not valid it will return the answer that it is not valid and the reason for the same. This makes it very easy to debug the issue and make the necessary correction.
