• Cloning existing software for commercial purposes - legal implications

  I have been asked to clone some existing software for a company. Basically its an old 16 bit DOS console app, which was supplied free of charge in I believe the late 80's. Having replaced the machine that needs to run it with a box running Win7 x64 they can't get it to work. It crashes every couple of minutes under DOSbox. The company that supplied it appears to no longer exist - if they did the company asking me to do this would almost certainly know about it. Its undetermined whether they have gone entirely or are just trading under a different name. If the latter they seem to have withdrawn from the market related to this product (because again, niche area, we should know about everyone there). What is the status to this with regards to copyright etc.? The main concern for the company involved is they want an identical interface to what they already have so I would have to clone this entirely. Having no source code / indication of the underlying mechanisms these would be written from scratch. Is an interface covered by copyright? / Does that still hold 30 years later? What is the assumed license when none at all is provided? Under UK law would I be under any serious risk were I to take on the project? How would this pan out if I then decided to sell the software on to other companies? Thanks

Following up on yesterday's post about Oracle VM VirtualBox being selected as the best virtualization solution for 2012 by the readers of Linux Journal, our Friday tip is about that very cool piece of software: Question: How do I move a VM from one machine to another with Oracle VM VirtualBox? Answer by Andy Hall, Product Management Director, Oracle Desktop Virtualization: There are a number of ways to do this, with pros and cons for each. The most reliable approach is to Export and Import virtual machines: From the VirtualBox manager, simply use the File…Export appliance menu and follow the wizard's lead. Move the resulting file(s) to the destination machine; and Import the VM into VirtualBox. This method will take longer and use more disk space than other methods because the configuration files and virtual hard drives are converted into an industry standard format (.ova or .ovf). But an advantage of this approach is that the creator of the virtual appliance can add a license which the importer will see and click-to-accept at import time. This is especially useful for ISVs looking to deliver pre-built, configured and tested appliances to their customers and prospects. Thanks Andy! • Meet the New Windows Azure

  Today we are releasing a major set of improvements to Windows Azure.  Below is a short-summary of just a few of them: New Admin Portal and Command Line Tools Today’s release comes with a new Windows Azure portal that will enable you to manage all features and services offered on Windows Azure in a seamless, integrated way.  It is very fast and fluid, supports filtering and sorting (making it much easier to use for large deployments), works on all browsers, and offers a lot of great new features – including built-in VM, Web site, Storage, and Cloud Service monitoring support. The new portal is built on top of a REST-based management API within Windows Azure – and everything you can do through the portal can also be programmed directly against this Web API. We are also today releasing command-line tools (which like the portal call the REST Management APIs) to make it even easier to script and automate your administration tasks.  We are offering both a Powershell (for Windows) and Bash (for Mac and Linux) set of tools to download.  Like our SDKs, the code for these tools is hosted on GitHub under an Apache 2 license. Virtual Machines Windows Azure now supports the ability to deploy and run durable VMs in the cloud.  You can easily create these VMs using a new Image Gallery built-into the new Windows Azure Portal, or alternatively upload and run your own custom-built VHD images. Virtual Machines are durable (meaning anything you install within them persists across reboots) and you can use any OS with them.  Our built-in image gallery includes both Windows Server images (including the new Windows Server 2012 RC) as well as Linux images (including Ubuntu, CentOS, and SUSE distributions).  Once you create a VM instance you can easily Terminal Server or SSH into it in order to configure and customize the VM however you want (and optionally capture your own image snapshot of it to use when creating new VM instances).  This provides you with the flexibility to run pretty much any workload within Windows Azure.   The new Windows Azure Portal provides a rich set of management features for Virtual Machines – including the ability to monitor and track resource utilization within them.  Our new Virtual Machine support also enables the ability to easily attach multiple data-disks to VMs (which you can then mount and format as drives).  You can optionally enable geo-replication support on these – which will cause Windows Azure to continuously replicate your storage to a secondary data-center at least 400 miles away from your primary data-center as a backup. We use the same VHD format that is supported with Windows virtualization today (and which we’ve released as an open spec), which enables you to easily migrate existing workloads you might already have virtualized into Windows Azure.  We also make it easy to download VHDs from Windows Azure, which also provides the flexibility to easily migrate cloud-based VM workloads to an on-premise environment.  All you need to do is download the VHD file and boot it up locally, no import/export steps required. Web Sites Windows Azure now supports the ability to quickly and easily deploy ASP.NET, Node.js and PHP web-sites to a highly scalable cloud environment that allows you to start small (and for free) and then scale up as your traffic grows.  You can create a new web site in Azure and have it ready to deploy to in under 10 seconds: The new Windows Azure Portal provides built-in administration support for Web sites – including the ability to monitor and track resource utilization in real-time: You can deploy to web-sites in seconds using FTP, Git, TFS and Web Deploy.  We are also releasing tooling updates today for both Visual Studio and Web Matrix that enable developers to seamlessly deploy ASP.NET applications to this new offering.  The VS and Web Matrix publishing support includes the ability to deploy SQL databases as part of web site deployment – as well as the ability to incrementally update database schema with a later deployment. You can integrate web application publishing with source control by selecting the “Set up TFS publishing” or “Set up Git publishing” links on a web-site’s dashboard: Doing do will enable integration with our new TFS online service (which enables a full TFS workflow – including elastic build and testing support), or create a Git repository that you can reference as a remote and push deployments to.  Once you push a deployment using TFS or Git, the deployments tab will keep track of the deployments you make, and enable you to select an older (or newer) deployment and quickly redeploy your site to that snapshot of the code.  This provides a very powerful DevOps workflow experience.   Windows Azure now allows you to deploy up to 10 web-sites into a free, shared/multi-tenant hosting environment (where a site you deploy will be one of multiple sites running on a shared set of server resources).  This provides an easy way to get started on projects at no cost. You can then optionally upgrade your sites to run in a “reserved mode” that isolates them so that you are the only customer within a virtual machine: And you can elastically scale the amount of resources your sites use – allowing you to increase your reserved instance capacity as your traffic scales: Windows Azure automatically handles load balancing traffic across VM instances, and you get the same, super fast, deployment options (FTP, Git, TFS and Web Deploy) regardless of how many reserved instances you use. With Windows Azure you pay for compute capacity on a per-hour basis – which allows you to scale up and down your resources to match only what you need. Cloud Services and Distributed Caching Windows Azure also supports the ability to build cloud services that support rich multi-tier architectures, automated application management, and scale to extremely large deployments.  Previously we referred to this capability as “hosted services” – with this week’s release we are now referring to this capability as “cloud services”.  We are also enabling a bunch of new features with them. Distributed Cache One of the really cool new features being enabled with cloud services is a new distributed cache capability that enables you to use and setup a low-latency, in-memory distributed cache within your applications.  This cache is isolated for use just by your applications, and does not have any throttling limits. This cache can dynamically grow and shrink elastically (without you have to redeploy your app or make code changes), and supports the full richness of the AppFabric Cache Server API (including regions, high availability, notifications, local cache and more).  In addition to supporting the AppFabric Cache Server API, it also now supports the Memcached protocol – allowing you to point code written against Memcached at it (no code changes required). The new distributed cache can be setup to run in one of two ways: 1) Using a co-located approach.  In this option you allocate a percentage of memory in your existing web and worker roles to be used by the cache, and then the cache joins the memory into one large distributed cache.  Any data put into the cache by one role instance can be accessed by other role instances in your application – regardless of whether the cached data is stored on it or another role.  The big benefit with the “co-located” option is that it is free (you don’t have to pay anything to enable it) and it allows you to use what might have been otherwise unused memory within your application VMs. 2) Alternatively, you can add “cache worker roles” to your cloud service that are used solely for caching.  These will also be joined into one large distributed cache ring that other roles within your application can access.  You can use these roles to cache 10s or 100s of GBs of data in-memory very effectively – and the cache can be elastically increased or decreased at runtime within your application: New SDKs and Tooling Support We have updated all of the Windows Azure SDKs with today’s release to include new features and capabilities.  Our SDKs are now available for multiple languages, and all of the source in them is published under an Apache 2 license and and maintained in GitHub repositories. The .NET SDK for Azure has in particular seen a bunch of great improvements with today’s release, and now includes tooling support for both VS 2010 and the VS 2012 RC. We are also now shipping Windows, Mac and Linux SDK downloads for languages that are offered on all of these systems – allowing developers to develop Windows Azure applications using any development operating system. Much, Much More The above is just a short list of some of the improvements that are shipping in either preview or final form today – there is a LOT more in today’s release.  These include new Virtual Private Networking capabilities, new Service Bus runtime and tooling support, the public preview of the new Azure Media Services, new Data Centers, significantly upgraded network and storage hardware, SQL Reporting Services, new Identity features, support within 40+ new countries and territories, and much, much more. • Are Intel compilers really better than Microsoft ones?

  Years ago I was surprised when discovered that Intel sells Studio compatible compilers. I tried it in particular for C/C++ as well as fantastic diagnostic tools. But the code was simply not that computationally intensive to notice the difference. The only impression was: did Intel really did it for me just now, Wow, amazing tools with nanoseconds resolution, unbeleivable. But the trial ended and team never seriously considered a purchase. From your experience, if license cost does not matter, which vendor is a winner ? It is not broad or vague question or attemt to spark a holy war. This sort of question about 2 very visible tools. Nobody likes when tools have any mysteries or surprises. And choices between best and best are always the pain. I also understand the "grass greener" argument. I want to hear all "what ifs" stories. What if Intel just locally optimizes it for the chip stepping of the month, and not every hardware target will actually work as well as Microsoft compiled ? What if AMD hardware is the target and everything will slow down for no reason ? Or on other hand, what if Intel's hardware has so many unnoticable opportunities, that Microsoft compiler writers are too slow to adopt and never implement in the compiler ? What if both are the same exactly, actually a single codebase just wrapped into 2 different boxes and licensed to both vendors by some 3rd party shop? And so on. But someone knows some answers.

• Did Oracle make public any plans to charge for JDK in the near future? [closed]

  I recently read an article: Twelve Disaster Scenarios Which Could Damage the Technology Industry which mentioned among other the possible "disaster scenarios" also: Oracle starts charging for the JDK, giving the following as argument: Oracle could start requiring license fees for the JDK from everyone but desktop users who haven't uninstalled the Java plug-in for some reason. This would burn down half the Java server-side market, but allow Oracle to fully monetize its acquisitions and investments. [...] Oracle tends to destroy markets to create products it can fully monetize. Even if you're not a Java developer, this would have a ripple effect throughout the market. [...] I actually haven't figured out why Larry hasn't decided Java should go this route yet. Some version of this scenario is actually in my company's statement of risks. I know guessing for the future is impossible, and speculating about that would be endless so I will try to frame my question in an objective answarable way: Did Oracle or someone from Oracle under anonymity, make public, or hinted, leaked to the public such a possibility or the above is plain journalistic speculation? I am unable to find the answer myself with Google generating a lot of noise by searching JDK.

• How to properly learn ASP.NET MVC

  Hello everyone, I have a question to ask and maybe some of you will think it's lame, but I hope someone will get me on the right track. So I've been programming for quite some time now. I started programming when I was about 13 or so on Delphi, but when I was about 17 or so I switched to C# and now I really like to program with it, mostly because it's syntax is very appealing to me, plus managed code is very good. So it all was good and fun but then I had some job openings that I of course took, but the problem with them is that they all are about web programming. And I had to learn PHP and MVC fundamentals. And I somewhat did while building applications using CI and Kohana framework. But I want to build websites using ASP.NET because I like C# much, much more than PHP. TL;DR I want to know ASP.NET MVC but I don't know where to start. What I want to start with is build some simple like CMS. But I don't know where to start. Do I use same logic as PHP? What do I use for DB connections? And also, if I plan to host something that is build with ASP.NET MVC3 on a hosting provider do I need to buy some kind of license?

• Executing NUnit Tests using the Visual Studio 2012 Test Runner

  At a recent Visual Studio 2012 event at the Calgary .NET User Group, I was told that I could run my NUnit tests directly in the Visual Studio 2012 without any special plugins.  Naturally, I was very excited and I immediately tried running my NUnit tests. I was somewhat disappointed to see that the Test Runner did not discover any of my NUnit tests.  Apparently, you do still need to install an extension that supports NUnit.  Microsoft has completely re-written the Test Runner in Visual Studio 2012 and opened it up for anyone to write Test Adapters for any unit test framework (not just MSTest).  Once the correct test adapters are installed, everything works great.  Luckily, there are a good number of adapters already written. Here are some Test Adapters that you might find useful: NUnit Test Adapter – This one is still in beta, but tit does work with the official Visual Studio 2012 release xUnit.net Test Adapter Silverlight Unit Test Adapter Chutzpah Test Adapter Overall, I still prefer the unit test runner in ReSharper, but this is a great new feature for those who might not have a ReSharper license.

• Developing games using virtualization on macOS (or Linux) [on hold]

  From what I've seen, most of the gamedev tools and engines (that could generate cross platform games) are not supported on Mac. Havok/Project Anarchy, UDK, GameMaker, e.g. . Basically, the only options I found are: Unity3d and monogame + xamarin. Unity is nice and I've been playing with it for some time, but the free version is quite limited when we're talking about shaders, that made me consider that as an indie developer, I might want more freedom to experiment new things, without paying the expensive unity license. I didn't try monogame + xamarin yet, and altough XNA is a very nice game framework, I'd like to have more freedom to experiment and finish a game first before paying for the IDE, which is not possible with the current Xamarin business model. That leaves me with the thought that I must go back to windows, which I'd preferably do it partially, if it's possible. Using BootCamp is something that I'd like to avoid, since it's a pain to reboot when changing OS and that would probably force me to become a 100% windows user. Is there anyone actually developing a game using virtualization solutions like parallels or vmwareFusion? How was your experience?

• What packages can i use to unroll a complete store with customer service?

  I havent bought the server yet (possible VPS) but i am thinking about using linux with apache and mono for asp.net support. I don't know much about this. What packages can i use together to have a store with customer support? What i like is 1) A store to purchase one item (its digital). More may be possible but they are likely to be addons which need the first item. 2) Have the the store send messages to my app which will generate registration key and deliver the digital item. 3) Create an account for that customer on a support site used for tickets 4) A Forum. I'd like a private forum for customers and may want their account to be disabled when their product license has expired. 5) A mailing list. I like non customers be able to subscribe to a list and i'd like to know if any customers are on it so i can send different emails to each if desired. Are there packages that make any of these easy? I dont mind writing glue code if i need to but i havent tried any stores, mailing list, ticket system but have installed a forum once long ago. My mail server will likely be through google apps.

• Accessing hardware via USB by proprietary windows software using Wine

  I have this proprietary software that access some hardware using USB. Over a year ago I tried to install it on a Ubuntu OS using Wine (the program is written for Windows). The UI seemed to work just fine but it had no access to the USB port. Back then I had to license a Windows copy in order to get the job done. Now, that Windows version we where using is deprecated and it is not longer available and available versions cost trice as much. So it is time to give Linux another try. How can I ensure that the USB is available for a Wine application? Neither the application nor the hardware install any driver, the app just pool all available USB drivers and make a handshake if it recognizes that the hardware is present. I want to minimize the test cases before abandoning Linux one more time. Update I've just tried again (with the hope an upgrade was made from last year), and it is not working. The proprietary windows app is not finding the hardware.

  So I'm about to submit a game to a competition, but as I looked through the rules a chunk grabbed my attention: All Entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned. Sponsor shall own all right, title and interest in and to each Entry, including without limitation all results and proceeds thereof and all elements or constituent parts of Entry (including without limitation the Mobile App, the Design Documents, the Video Trailer, the Playable and all illustrations, logos, mechanicals, renderings, characters, graphics, designs, layouts or other material therein) and all copyrights and renewals and extensions of copyrights therein and thereto. • Selling an open source project: some issues

  I am the creator / main developer of a small sized open source (PHP) project (GPL3). Currently there is a development team of 3 people (me included). This team has been quite active for some time, but since almost 2 years not much has happened. I myself have decided I want to stop working on the project, but I can't just leave the project because I care about it and I know if I abandon it, it will just be a matter of time before the project completely dies. At this moment, there are still some users and the project is only slightly out-of-date. So I'm thinking about selling the whole project. Of course I'd need to get consent of the other developers, but for now I'm assuming that's not a big problem. So at this moment I have 2 questions: 1) If the project would be sold to a commercial party, would it be possible for them to convert the project to closed source? I would prefer to sell the project to a company/organization that would continue the development under an open source license. 2) Does anyone have any tips to find interested parties? I don't know if I just want to put up a "For Sale" sign on the website of the project. Maybe someone has experience with a comparable situation. Ok guys, thanks in advance!

• Looking for a small, light scene graph style abstraction lib for shader based OpenGL

  I'm looking for a 'lean and mean' c/c++ scene graph library for OpenGL that doesn't use any deprecated functionality. It should be cross platform (strictly speaking I just dev on Linux so no love lost if it doesn't work on Windows), and it should be possible to deploy to mobile targets (ie OpenGLES2, and no crazy mandatory dependencies that wouldn't port well to modern mobile frameworks like iOS, Android, etc), with a license that's compatible with closed source software (LGPL or more liberal). Specific nice-to-haves would be: Cameras and Viewers (trackball, fly-by, etc) Object transform hierarchies (if B is a child of A, and you move A, B has the same transform applied to it) Simple animation Scene optimization (frustum culling, use VBOs, minimize state changes, etc) Text I've played around with OpenSceneGraph a lot and it's pretty amazing for fixed function pipeline stuff, but I've had a few of problems using it with the programmable pipeline and after going through their mailing list, it seems several people have had similar issues (going back years). Kitware's VES looks neat (http://www.vtk.org/Wiki/VES), but VES + VTK is pretty heavy. VTK is also typically for analyzing scientific data and I've read that it's not that appropriate for a general use case (not that great at rendering a lot of objects on scene,etc) I'm currently looking at VisualizationLibrary (http://www.visualizationlibrary.org/documentation/pag_gallery.html) which looks like it offers some of the functionality I'd like, but it doesn't explicitly support mobile targets. Other solutions like Ogre, Horde3D, Irrlicht, etc tend to be full on game engines and that's not really what I'm looking for. I'd like some suggestions for other libraries that I may have missed... please note I'm not willing to roll my own solution from scratch.

• The MsC gray zone: How to deal with the "too unexperienced on engineering/too under-qualified for research" situation?

  Last year I've got a MsC degree on CS. On the beginning of the MsC course, I was keen on moving on with research and go for a PhD. However, as the months passed, I started to feel the urge to write software that people would, well, actually use. The programming bug had bitten me, again. So, I decided that before deciding on getting a PhD degree, I would spend some time on the "real world", working as a software developer. Sadly, most companies here in Brazil are "services" companies that seem to be stuck on the 80s when it comes to software development. I have to fend off pushy managers, less-than-competent coworkers and outrageous software requirements (why does everyone seem to need a 50k Oracle license and a behemoth Websphere AS for their CRUD applications?) on a daily basis, and even though I still love software development, the situation is starting to touch a nerve. And, mind you, I'm already lucky for getting a job at a place that isn't a plain software sweatshop. Sure, there are better places around here or I could always try my luck abroad, but then I hit the proverbial brick wall: Sorry, you're too unexperienced as a developer and too under-qualified as a researcher I've already heard this, and variations of that, multiple times. Research position recruiters look for die-hard, publication-ridden, rockstar PhDs, while development position recruiters look for die-hard, experience-ridden, rockstar programmers. To most, my MsC degree seems like a minor bump on my CV (and an outright waste of time for some). Applying for abroad positions is even harder, since the employer would have to deal of the hassle of a VISA process, which I understand that, sometimes, is too much. Now I'm feeling I've reached a dead-end. I'm certain that development (and not research) is my thing, so should I just dismiss my MsC (or play it as a "trump card") and play the "big fish on a small pond" role while I gather some experience and contribute on some open-source projects as a plus? Is there a better way to handle this?

• Guitar hero clone and music

  I am an indie game developer and I am doing a game similar to guitar hero. I am using tracks composed by musicians and I contacted them to sing a licensing contract. As is my first indie project I have no idea on how I should deal with the royalties aspect of this because each track as an ISRC code and each time a track is played in public there is a fee to pay to the "local" registration authority. An iPhone game it is downloaded and not played on air (or physically distributed), and hence I think there is a specific legislation for this that specifies how much one should pay. I own some of the tracks composed and for this I think I won't have to pay a royalty (even if the track has an ISRC code) but for other tracks I just have a license "to use". I wonder how a game like Guitar hero can sell on iPhone for as little as 0,99$ and then have "in app purchases" for packs of 3 songs (for about 2 dollars) and make a profit (I imagine they will have to pay a ISRC royalty). Does anyone of you have any idea of this can work or if there is a section in this forum where I can ask this question? I understand is not about coding but I think is about development of a game in the broader sense.

• Does this licensing clause allow redistribution of this application?

  As a software developer, I find a frequent need to create icons for my applications. Nothing has ever worked as well as IcoFX for this purpose. Unfortunately, the program is no longer free - but I still have the installer for an older version. My question is whether or not I can distribute copies of the installer. The license agreement contains the following pertinent clauses: 6. All redistributions of the Software's files must retain all copyright notices and web site addresses that are currently in place, and must include this list of conditions without modification. 7. None of the Software's files may be redistributed for profit or as part of another Software package without express written permission of the Author. 10. The Author reserves his rights to modify this agreement in the future. The first two clauses would seem to suggest that I can legally distribute verbatim copies of the installer but the last clause has me confused. If the author modifies the agreement and removes the ability to distribute copies, does it apply to my copy that I downloaded a while back?

• Are Intel compilers really better than the Microsoft ones?

  Years ago, I was surprised when I discovered that Intel sells Visual Studio compatible compilers. I tried it in particular for C/C++ as well as fantastic diagnostic tools. But the code was simply not that computationally intensive to notice the difference. The only impression was: did Intel really do it for me just now, wow, amazing tools with nanoseconds resolution, unbelievable. But the trial ended and the team never seriously considered a purchase. From your experience, if license cost does not matter, which vendor is the winner? It is not a broad or vague question or attemt to spark a holy war. This sort of question is about two very visible tools. Nobody likes when tools have any mysteries or surprises. And choices between best and best are always the pain. I also understand the grass is always greener argument. I want to hear all "what ifs" stories. What if Intel just locally optimizes it for the chip stepping of the month, and not every hardware target will actually work as well as Microsoft compiled? What if AMD hardware is the target and everything will slow down for no reason? Or on the other hand, what if Intel's hardware has so many unnoticable opportunities, that Microsoft compiler writers are too slow to adopt and never implement it in the compiler? What if both are the same exactly, actually a single codebase just wrapped into two different boxes and licensed to both vendors by some third-party shop? And so on. But someone knows some answers.
