  • build error with boost spirit grammar (boost 1.43 and g++ 4.4.1)

    I'm having issues getting a small spirit/qi grammar to compile. The build stack trace is fugly enought to not make any sense to me (despite some assertion_failed i could notice in there but that didn't brought much information) the input grammar header:   • Magento My Account Layout XML Problem

    Hi there, I'm having issues getting the customer.xml layout file to work properly for the customer's "my account" pages. The navigation links and the previously ordered items that are usually on the left hand side of the page won't show up on the page, but if I change the reference name to "content" in the xml file, it shows up (except it's obviously then on the right hand side). I've checked the template it's referencing (2columns-left.phtml), and the getChildHtml('left') is there in the correct position. I've tried everything I can think of (changing the name of the reference in both the template and the layout xml, for example) to no avail. The templates that the layout is referencing are obviously working because they do show up when put into the "content" area. This installation of magento is version 1.3.1.1. I appreciate any advice you have to give me... *Update: I tried changing the reference to "global_messages", and it doesn't show there either.   • Featureful commercial text editors?

    I'm willing to buy tools if they add genuine value over a FOSS equivalent. One thing I wouldn't mind having is an editor with the power of Emacs, but made more user-friendly. There seem to be several commercial editors out there, but I can't find much discussion of them online. Maybe it's because the kind of people who use commercial software don't have time to do much blogging. ;-) If you have used any, what was your evaluation? I'd especially like to hear how you would compare them to Emacs. I'm thinking of editors like VEDIT, Boxer, Crisp, UltraEdit, SlickEdit, etc. To get things started, I tried EditPad Pro because I needed something on a Win98SE box. I was attracted by its powerful support for regexps, but I didn't use it for long. One annoyance was that find-in-files was only available in a separate product you had to buy. The main problem, though, was stability. It sometimes hung and I lost a few files because it corrupted them while editing. After a couple weeks, I found that I was avoiding using it, so I just uninstalled. Edit: Ah...I need to remove some ambiguity. With reference to Emacs, "power" often means its potential for customization. This malleability comes from having an architecture in which most of the functionality is written in a scripting language that runs on a compiled core. Emacs (with elisp) is by far the most widely known such system among home users, but there have been other heavily used editors such as Freemacs (MINT), JED (S-Lang), XEDIT (Rexx), ADAM (TPU), and SlickEdit (Slick-C). In this case, by "power" I'm not referring to extensibility but to realized features. There are three main areas which I think a commercial text editor might be an improvement over Emacs: Stability The only apps I regularly use on Linux that give me flaky behavior are Emacs, Gedit, and Geany. On Windows, I like the look and features of Notepad++, but I find it extremely unstable, especially if I try to use the plugins. Whatever I happen to be doing, I'm using some text editor practically all day long. If I could switch to an editor that never gave me problems, it would definitely lower my stress level. Tools When I started using Emacs, I searched the manual cover to cover to gleam ideas for clever, useful things I could do with it. I'd like to see lots of useful features for editing code, based on detailed knowledge of what the system can do and the accumulated feedback of users. Polish The rule of threes goes that if you develop something for yourself, it's three times harder to make it usable in-house, and three times harder again to make it a viable product for sale. It's understandable, but free software development doesn't seem to benefit from much usability testing. BTW, texteditors.org is a fantastic resource for researching text editors.

    Yahoo Mail is sending our server's transactional emails to the Spam folder, even though we have taken quite a few anti-spam steps. By contrast, Gmail allows the messages through to the inbox just fine. Here are the things which are in place: SPF is set up for the domain holsteinplaza.com. Yahoo reports spf=pass in the message headers. DKIM is set up for the domain holsteinplaza.com. Yahoo reports dkim=pass in the message headers. We have a proper reverse DNS entry for the sending mail server. Name - IP matches IP - Name. Neither Domainkeys nor SenderID are set up. From what I can tell, DKIM is the way of the future, and there is not much to be gained from adding Domainkeys or SenderID. Following are the headers. Any ideas what more I should do to get Yahoo to stop flagging the emails as spam?   • Replacing jQuery.live() with jQuery.on()

    jQuery 1.9 and 1.10 have introduced a host of changes, but for the most part these changes are mostly transparent to existing application usage of jQuery. After spending some time last week with a few of my projects and going through them with a specific eye for jQuery failures I found that for the most part there wasn't a big issue. The vast majority of code continues to run just fine with either 1.9 or 1.10 (which are supposed to be in sync but with 1.10 removing support for legacy Internet Explorer pre-9.0 versions). However, one particular change in the new versions has caused me quite a bit of update trouble, is the removal of the jQuery.live() function. This is my own fault I suppose - .live() has been deprecated for a while, but with 1.9 and later it was finally removed altogether from jQuery. In the past I had quite a bit of jQuery code that used .live() and it's one of the things that's holding back my upgrade process, although I'm slowly cleaning up my code and switching to the .on() function as the replacement. jQuery.live() jQuery.live() was introduced a long time ago to simplify handling events on matched elements that exist currently on the document and those that are are added in the future and also match the selector. jQuery uses event bubbling, special event binding, plus some magic using meta data attached to a parent level element to check and see if the original target event element matches the selected selected elements (for more info see Elijah Manor's comment below). An Example Assume a list of items like the following in HTML for example and further assume that the items in this list can be appended to at a later point. The behavior of the .live handler generally was the same as the corresponding simple event handlers like .click(), except that you have to explicitly name the event instead of using one of the methods. Re-writing with jQuery.on() With .live() removed in 1.9 and later we have to re-write .live() code above with an alternative. The jQuery documentation points you at the .on() or .delegate() functions to update your code. jQuery.on() is a more generic event handler function, and it's what jQuery uses internally to map the high level event functions like .click(),.change() etc. that jQuery exposes. Using jQuery.on() however is not a one to one replacement of the .live() function. While .on() can handle events directly and use the same syntax as .live() did, you'll find if you simply switch out .live() with .on() that events on not-yet existing elements will not fire. IOW, the key feature of .live() is not working. You can use .on() to get the desired effect however, but you have to change the syntax to explicitly handle the event you're interested in on the container and then provide a filter selector to specify which elements you are actually interested in for handling the event for. Sounds more complicated than it is and it's easier to see with an example. For the list above hooking .postitem clicks, using jQuery.on() looks like this:$("#PostItemContainer").on("click", ".postitem", function() {...}); You specify a container that can handle the .click event and then provide a filter selector to find the child elements that trigger the  the actual event. So here #PostItemContainer contains many .postitems, whose click events I want to handle. Any container will do including document, but I tend to use the container closest to the elements I actually want to handle the events on to minimize the event bubbling that occurs to capture the event. With this code I get the same behavior as with .live() and now as new .postitem elements are added the click events are always available. Sweet. Here's the full event signature for the .on() function: .on( events [, selector ] [, data ], handler(eventObject) ) Note that the selector is optional - if you omit it you essentially create a simple event handler that handles the event directly on the selected object. The filter/child selector required if you want life-like - uh, .live() like behavior to happen. While it's a bit more verbose than what .live() did, .on() provides the same functionality by being more explicit on what your parent container for trapping events is. .on() is good Practice even for ordinary static Element Lists As a side note, it's a good practice to use jQuery.on() or jQuery.delegate() for events in most cases anyway, using this 'container event trapping' syntax. That's because rather than requiring lots of event handlers on each of the child elements (.postitem in the sample above), there's just one event handler on the container, and only when clicked does jQuery drill down to find the matching filter element and tries to match it to the originating element. In the early days of jQuery I used manually build handlers that did this and manually drilled from the event object into the originalTarget to determine if it's a matching element. With later versions of jQuery the various event functions in jQuery essentially provide this functionality out of the box with functions like .on() and .delegate(). All of this is nothing new, but I thought I'd write this up because I have on a few occasions forgotten what exactly was needed to replace the many .live() function calls that litter my code - especially older code. This will be a nice reminder next time I have a memory blank on this topic.   • Making Money from your SQL Server Blog

    My SQL Server blog reading list is around one hundred blogs.  Many people are writing great content and generating lots of page views.  I see some of them running Google AdSense and trying to make a little money off their traffic.  If you want to earn some some extra money from what you’ve written there are a couple of options.  And one new option that I’m announcing here. Background Internet advertising is sold based on a few different pricing schemes.  Flat Fee.  You offer either all your impressions (page views) or some percentage of your impressions in exchange for a flat monthly fee.  CPM or cost per thousand impressions.  If the quoted price is $2 CPM you’ll get $2 for every 1,000 times the ad is displayed.  While you might think the “M” means millions, the “M” in CPM is the roman numeral for 1,000. CPC or cost per click.  This is also called PPC or pay per click.  In this method you get paid based on how many clicks there are on the ad.  CPA or cost per action.  In this method you get paid based on an action that occurs on the advertisers site after they click on the ad.  This is typically some type of sign up form.  This is how most affiliate programs work. Darren Rowse at ProBlogger has been writing about blogging and making money off blogs for years.  He has a good introduction to making money on your blog in his “Making Money” section.  If you’re interested in learning more he has a post up titled How to Make More Money From Your Blog in the New Year that links to many of his best posts on the subject. Google AdSense This is the most common method for people earning money from their blogging.  It’s easy to setup and administer.  You tell AdSense what size ads you’d like to run and it gives you a little piece of JavaScript to put on your site.  AdSense quickly learns the topics you write about and displays ads that are appropriate for your site.  I typically see ads for hosting, SQL Server tools and developer tools running in AdSense slots.  AdSense pays on a CPC model.  If you translate that back to CPM pricing you’ll see rates from $0.50 to $1.00 CPM. Amazon While you might not make much money writing books it’s now possible to make even less helping Amazon sell them.  You can sign up for an Amazon affiliate program.  Each time you send Amazon a link and someone buys the book you get a cut of that sale.  This is the CPA model from above.  Amazon can help you build some pretty nice “stores”.  Here’s the SQL Server bookstore I built for SQLTeam.com.  If you’re just putting in a page with books like I’ve done on SQLTeam you should keep your expectations low.  If you’re writing book reviews of suggesting books on your blog it really does make sense to setup an Amazon affiliate link.  People are much more likely to buy a book based on a review from a trusted source.  I always try to buy through a referral link if there is one. Amazon pays about 4% of the price as a referral fee.  You also get credit for anything else they buy while on the site.  I recently had someone buy an iPod nano with their SQL Server book making me an extra $5.60 richer!  Estimating how much you can make is difficult though.  How much attention you draw to the links and book reviews can dramatically affect the earnings. Private Ad Sales This is the hardest but potentially most lucrative option.  You sell advertising directly to companies that want to sell things to your readers.  Typically this would be SQL Server tool vendors, hosting companies or anyone else that wants to make money off database administrators.  This is also the most difficult to do.  You’ll need the contacts at the companies and enough page views to make it worth their while.  You’ll also need software to track the page views and clicks, geo-target your ads and smooth out the impressions.  Your earnings are based on whatever you can negotiate with the companies. SQL Server Ad Network For the last couple of years I’ve run any extra ads that I sold on the SQLTeam Weblogs.  You can see an example of that on Mladen’s blog.  The ad in the upper right corner is one that I’m running for him.  (Note: Many of the ads I’m running are geo-targeted to only appear in English speaking countries.  You may see a different set of ads outside the US, Canada and the UK.  You can also see he has a couple of Google ads on his blog.)  When I run ads on his blog I split the advertising revenue with him.  They make a little and I make a little. I recently started to expand this and sell advertising specifically to run on SQL Server-related blogs.  I’m also starting to run ads on non-SQLTeam blogs.  The only way I can sell more advertising is to have more blogs to run it on.  And that’s where you come in. I’ve created a SQL Server advertising network.  I handle all the ad sales and provide the technology to serve the ads.  I handle collections and payments back to you.  You get paid at the end of each month regardless of when (or if) the advertiser actually pays.  All you need to do is add a small piece of JavaScript to your site to display the ads. If you’re writing about SQL Server and interested in earning a little money for your site I’d like to talk to you.  You can use the Contact Us page on SQLTeam.com to reach me.  Running advertising on your blog isn’t for everyone.  If you’re concerned about what advertisers might think about certain posts then you might not be a good fit.  For the most part this isn’t an issue.  You’ll also need to have a PayPal account to receive payments.  You probably won’t get rich doing this.  But you can earn extra cash on the side for doing what you would do anyway.  I do know that people have earned enough to buy themselves a nice laptop doing this.   • How to Easily Put a Windows PC into Kiosk Mode With Assigned Access

    Windows 8.1′s Assigned Access feature allows you to easily lock a Windows PC to a single application, such as a web browser. This feature makes it easy for anyone to configure Windows 8.1 devices as point-of-sale or other kiosk systems. In the past, setting up a Windows PC in kiosk mode involved much more work, requiring the use of third-party software, group policy, or Linux distributions designed around kiosk mode. Assigned Access is available on Windows 8.1 RT, Windows 8.1 Professional, and Windows 8.1 Enterprise. The standard edition of Windows 8.1 doesn’t support Assigned Access. Create a User Account for Assigned Access Rather than turn your entire computer into a locked-down kiosk system, Assigned Access allows you to create a separate user account that can only launch a single app — such as a web browser. To set this up, you must be logged into Windows as a user with administrator permissions. First, open the PC settings app — swipe in from the right or press Windows Key + C to open the charms bar, tap Settings, and tap Change PC settings. In the PC settings app, select Accounts and select Other accounts. Use the Add an account button to create a new Windows account. Select  the “Sign in without a Microsoft account” option and select Local account to create a local user account. You could also create a Microsoft account, but you may not want to do this if you just want a locked-down account with only browser access. If you need to install apps from the Windows Store to use in Assigned Access mode, you’ll have to set up a Microsoft account instead of a local account. A local account will still allow you access to the preinstalled apps, such as Internet Explorer. You may want to create a user account with a blank password. This would make it simple for anyone to access kiosk mode, even if the system becomes locked or needs to be rebooted. The account will be created as a standard user account with limited permissions. Leave it as a standard user account — don’t make it an administrator account. Set Up Assigned Access Once you’ve created an account, you’ll first need to sign into it. If you don’t, you’ll see a “This account has no apps” message when trying to enable Assigned Access. Go back to the welcome screen, log in to the new account you created, and allow Windows to go through the first-time account setup process. If you want to use a non-default app in kiosk mode, install it while logged in as that user account. Once you’re done, log out of the other account, log back in as your administrator account, and go back to the Other accounts screen. Click the Set up an account for assigned access option to continue. Select the user account you created and select the app you want to limit the account to. For a web-based kiosk, this can be a web browser such as the Modern version of Internet Explorer. Businesses can also create their own Modern apps and set them to run in kiosk mode in this way. Note that Microsoft’s documentation says “web browsers are not good choices for assigned access” because they require more permissions than average Modern (or “Windows Store”) apps. However, if you want to provide a kiosk for web-browsing, using Assigned Access is a much better option than using Guest Mode and offering up a full Windows desktop. When you’re done, restart your PC and log in as the Assigned Access account. Windows will automatically open the app you chose and won’t allow a user to leave that app. Standard Windows 8 features like the charms bar, app switcher, and Start screen won’t appear. Pressing the Windows key once will do nothing. To sign out of Assigned Access mode, press the Windows key five times — quickly — while signed in. You’ll be sent back to the standard login screen. The account will actually still be logged in and the app will remain running — this method just “locks” the screen and allows another user to log in. Automatically Log Into Assigned Access Whenever your Windows device boots, you can log into the Assigned Access account and turn it into a kiosk system. While this isn’t ideal for all kiosk systems, you may want the device to automatically launch the specific app when it boots without requiring any login process. To do so, you’ll just need to have Windows automatically log into the Assigned Access account when it boots. This option is hidden and not available in the standard Control Panel. You’ll need to use the hidden netplwiz Control Panel tool to set up automatic login on boot. If you didn’t create a password for the user account, leave the Password field empty while configuring this. Security Considerations If you’re using this feature to turn a Windows 8.1 system into a kiosk and leaving it open to the public, remember to consider security. Anyone could come up to the system, press the Windows key five times, and try to log into your standard administrator user account. Ensure the administrator user account has a strong password so people won’t be able to get past the kiosk system’s limitations and tamper with the system. Even Windows 8′s detractors have to admit that it’s an ideal system for a touch-screen kiosk device, running either a browser or another specific application. Assigned Access finally makes this easy to set up on Windows systems in the real world — no IT experience, third-party software, or Linux distributions necessary.

    Maximizing business process efficiencies in a heterogeneous environment is very difficult. The difficulty stems from the fact that the various applications across the Information Technology (IT) landscape employ different integration standards, different message passing strategies, and different workflow engines. Vendors such as Oracle and others are delivering tools to help IT organizations manage the complexities introduced by these differences. But the one remaining intractable problem impacting efficient operations is the fact that these applications have different definitions for the same business data. Business data is your business information codified for computer programs to use. A good data model will represent the way your organization does business. The computer applications your organization deploys to improve operational efficiency are built to operate on the business data organized into this schema.  If the schema does not represent how you do business, the applications on that schema cannot provide the features you need to achieve the desired efficiencies. Business processes span these applications. Data problems break these processes rendering them far less efficient than they need to be to achieve organization goals. Thus, the expected return on the investment in these applications is never realized. The success of all business processes depends on the availability of accurate master data.  Clearly, the solution to this problem is to consolidate all the master data an organization uses to run its business. Then clean it up, augment it, govern it, and connect it back to the applications that need it. Until now, this obvious solution has been difficult to achieve because no one had defined a data model sufficiently broad, deep and flexible enough to support transaction processing on all key business entities and serve as a master superset to all other operational data models deployed in heterogeneous IT environments. Today, the situation has changed. Oracle has created an operational data model (aka schema) that can support accurate and consistent master data across heterogeneous IT systems. This is foundational for providing a way to consolidate and integrate master data without having to replace investments in existing applications. Customers are serviced. And across this entire spectrum, Employees do the procuring, supporting, engineering, producing, selling and servicing. Not shown, but not to be overlooked, are the accounting and the financial processes associated with all this procuring, manufacturing, and selling activity. Supporting all these applications is the master data. When this data is fragmented and inconsistent, the business processes fail and inefficiencies multiply. But imagine having all the data under these operational business processes in one place. ·            The same accurate and timely customer data will be provided to all your operational applications from the call center to the point of sale. ·            The same accurate and timely supplier data will be provided to all your operational applications from supply chain planning to procurement. ·            The same accurate and timely product information will be available to all your operational applications from demand chain planning to marketing. You would have a single version of the truth about your assets, financial information, customers, suppliers, employees, products and services to support your business automation processes as they flow across your business applications. All company and partner personnel will access the same exact data entity across all your channels and across all your lines of business. No other MDM vendor has this capability. Everyone else has either one entity they can master or separate disconnected models for various business entities. Higher level integrations are made available, but that is a weak architectural alternative to data level integration in this critically important aspect of Master Data Management.

    Note - please pay attention to the date of this post. As much as I attempt to make the information below accurate, the nature of distributed computing means that components, units and pricing will change over time. The definitive costs for Microsoft Windows Azure and SQL Azure are located here, and are more accurate than anything you will see in this post: http://www.microsoft.com/windowsazure/offers/  When writing software that is run on a Platform-as-a-Service (PaaS) offering like Windows Azure / SQL Azure, one of the questions you must answer is how much the system will cost. I will not discuss the comparisons between on-premise costs (which are nigh impossible to calculate accurately) versus cloud costs, but instead focus on creating a general model for estimating costs for a given application. You should be aware that there are (at this writing) two billing mechanisms for Windows and SQL Azure: “Pay-as-you-go” or consumption, and “Subscription” or commitment. Conceptually, you can consider the former a pay-as-you-go cell phone plan, where you pay by the unit used (at a slightly higher rate) and the latter as a standard cell phone plan where you commit to a contract and thus pay lower rates. In this post I’ll stick with the pay-as-you-go mechanism for simplicity, which should be the maximum cost you would pay. From there you may be able to get a lower cost if you use the other mechanism. In any case, the model you create should hold. Developing a good cost model is essential. As a developer or architect, you’ll most certainly be asked how much something will cost, and you need to have a reliable way to estimate that. Businesses and Organizations have been used to paying for servers, software licenses, and other infrastructure as an up-front cost, and power, people to the systems and so on as an ongoing (and sometimes not factored) cost. When presented with a new paradigm like distributed computing, they may not understand the true cost/value proposition, and that’s where the architect and developer can guide the conversation to make a choice based on features of the application versus the true costs. The two big buckets of use-types for these applications are customer-based and steady-state. In the customer-based use type, each successful use of the program results in a sale or income for your organization. Perhaps you’ve written an application that provides the spot-price of foo, and your customer pays for the use of that application. In that case, once you’ve estimated your cost for a successful traversal of the application, you can build that into the price you charge the user. It’s a standard restaurant model, where the price of the meal is determined by the cost of making it, plus any profit you can make. In the second use-type, the application will be used by a more-or-less constant number of processes or users and no direct revenue is attached to the system. A typical example is a customer-tracking system used by the employees within your company. In this case, the cost model is often created “in reverse” - meaning that you pilot the application, monitor the use (and costs) and that cost is held steady. This is where the comparison with an on-premise system becomes necessary, even though it is more difficult to estimate those on-premise true costs. For instance, do you know exactly how much cost the air conditioning is because you have a team of system administrators? This may sound trivial, but that, along with the insurance for the building, the wiring, and every other part of the system is in fact a cost to the business. There are three primary methods that I’ve been successful with in estimating the cost. None are perfect, all are demand-driven. The general process is to lay out a matrix of: components units cost per unit and then multiply that times the usage of the system, based on which components you use in the program. That sounds a bit simplistic, but using those metrics in a calculation becomes more detailed. In all of the methods that follow, you need to know your application. The components for a PaaS include computing instances, storage, transactions, bandwidth and in the case of SQL Azure, database size. In most cases, architects start with the first model and progress through the other methods to gain accuracy. Simple Estimation The simplest way to calculate costs is to architect the application (even UML or on-paper, no coding involved) and then estimate which of the components you’ll use, and how much of each will be used. Microsoft provides two tools to do this - one is a simple slider-application located here: http://www.microsoft.com/windowsazure/pricing-calculator/  The other is a tool you download to create an “Return on Investment” (ROI) spreadsheet, which has the advantage of leading you through various questions to estimate what you plan to use, located here: https://roianalyst.alinean.com/msft/AutoLogin.do?d=176318219048082115  You can also just create a spreadsheet yourself with a structure like this: Program Element Azure Component Unit of Measure Cost Per Unit Estimated Use of Component Total Cost Per Component Cumulative Cost               Of course, the consideration with this model is that it is difficult to predict a system that is not running or hasn’t even been developed. Which brings us to the next model type. Measure and Project A more accurate model is to actually write the code for the application, using the Software Development Kit (SDK) which can run entirely disconnected from Azure. The code should be instrumented to estimate the use of the application components, logging to a local file on the development system. A series of unit and integration tests should be run, which will create load on the test system. You can use standard development concepts to track this usage, and even use Windows Performance Monitor counters. The best place to start with this method is to use the Windows Azure Diagnostics subsystem in your code, which you can read more about here: http://blogs.msdn.com/b/sumitm/archive/2009/11/18/introducing-windows-azure-diagnostics.aspx This set of API’s greatly simplifies tracking the application, and in fact you can use this information for more than just a cost model. After you have the tracking logs, you can plug the numbers into ay of the tools above, which should give a representative cost or in some cases a unit cost. The consideration with this model is that the SDK fabric is not a one-to-one comparison with performance on the actual Windows Azure fabric. Those differences are usually smaller, but they do need to be considered. Also, you may not be able to accurately predict the load on the system, which might lead to an architectural change, which changes the model. This leads us to the next, most accurate method for a cost model. Sample and Estimate Using standard statistical and other predictive math, once the application is deployed you will get a bill each month from Microsoft for your Azure usage. The bill is quite detailed, and you can export the data from it to do analysis, and using methods like regression and so on project out into the future what the costs will be. I normally advise that the architect also extrapolate a unit cost from those metrics as well. This is the information that should be reported back to the executives that pay the bills: the past cost, future projected costs, and unit cost “per click” or “per transaction”, as your case warrants. The challenge here is in the model itself - statistical methods are not foolproof, and the larger the sample (in this case I recommend the entire population, not a smaller sample) is key.     Effective June 29th, Oracle Partner Store (OPS) will release the enhancements listed below to improve your overall ordering experience. v Online Transactional Oracle Master Agreement (Online TOMA) The Online TOMA enables end users to execute a transactional end user license agreement with Oracle. The new Online TOMA in OPS will replace the need for you to obtain a signed hard copy of the TOMA from the end user. You will now initiate the Online TOMA via OPS. Navigation: OPS Home > Order Tools > Online TOMA Query > Request Online TOMA> End User Contact, click “Select for TOMA” > Select Language > Submit (an automated email is sent immediately to the requestor and the end user) Ø The Online TOMA can also be initiated from the ‘My OPS’ tab.   • A Bite With No Teeth&ndash;Demystifying Non-Compete Clauses

    *DISCLAIMER: I am not a lawyer and this post in no way should be considered legal advice. I’m also in Canada, so references made are to Canadian court cases. I received a signed letter the other day, a reminder from my previous employer about some clauses associated with my employment and entry into an employee stock purchase program. So since this is in effect for the next 12 months, I guess I’m not starting that new job tomorrow. I’m kidding of course. How outrageous, how presumptuous, pompous, and arrogant that a company – any company – would actually place these conditions upon an employee. And yet, this is not uncommon. Especially in the IT industry, we see time and again similar wording in our employment agreements. But…are these legal? Is there any teeth behind the threat of the bite? Luckily, the answer seems to be ‘No’. I want to highlight two cases that support this. The first is Lyons v. Multari. In a nutshell, Dentist hires younger Dentist to be an associate. In their short, handwritten agreement, a non-compete clause was written stating “Protective Covenant. 3 yrs. – 5mi” (meaning you can’t set up shop within 5 miles for 3 years). Well, the young dentist left and did start an oral surgery office within 5 miles and within 3 years. Off to court they go! The initial judge sided with the older dentist, but on appeal it was overturned. Feel free to read the transcript of the decision here, but let me highlight one portion from section [19]: The general rule in most common law jurisdictions is that non-competition clauses in employment contracts are void. The sections following [19] explain further, and discuss Elsley v. J.G. Collins Insurance Agency Ltd. and its impact on Canadian law in this regard. The second case is Winnipeg Livestock Sales Ltd. v. Plewman. Desmond Plewman is an auctioneer, and worked at Winnipeg Livestock Sales. Part of his employment agreement was that he could not work for a competitor for 18 months if he left the company. Well, he left, and took up an important role in a competing company. The case went to court and as with Lyons v. Multari, the initial judge found in favour of the plaintiffs. Also as in the first case, that was overturned on appeal. Again, read through the transcript of the decision, but consider section [28]: In other words, even though Plewman has a great deal of skill as an auctioneer, Winnipeg Livestock has no proprietary interest in his professional skill and experience, even if they were acquired during his time working for Winnipeg Livestock.  Thus, Winnipeg Livestock has the burden of establishing that it has a legitimate proprietary interest requiring protection.  On this key question there is little evidence before the Court.  The record discloses that part of Plewman’s job was to “mingle with the … crowd” and to telephone customers and prospective customers about future prospects for the sale of livestock.  It may seem reasonable to assume that Winnipeg Livestock has a legitimate proprietary interest in its customer connections; but there is no evidence to indicate that there is any significant degree of “customer loyalty” in the business, as opposed to customers making choices based on other considerations such as cost, availability and the like. So are there any incidents where a non-compete can actually be valid? Yes, and these are considered “exceptional” cases, meaning that the situation meets certain circumstances. Michael Carabash has a great blog series discussing the above mentioned cases as well as the difference between a non-compete and non-solicit agreement. He talks about the exceptional criteria: In summary, the authorities reveal that the following circumstances will generally be relevant in determining whether a case is an “exceptional” one so that a general non-competition clause will be found to be reasonable: - The length of service with the employer. - The amount of personal service to clients. - Whether the employee dealt with clients exclusively, or on a sustained or     recurring basis. - Whether the knowledge about the client which the employee gained was of a   confidential nature, or involved an intimate knowledge of the client’s   particular needs, preferences or idiosyncrasies. - Whether the nature of the employee’s work meant that the employee had   influence over clients in the sense that the clients relied upon the employee’s   advice, or trusted the employee. - If competition by the employee has already occurred, whether there is   evidence that clients have switched their custom to him, especially without   direct solicitation. - The nature of the business with respect to whether personal knowledge of   the clients’ confidential matters is required. - The nature of the business with respect to the strength of customer loyalty,   how clients are “won” and kept, and whether the clientele is a recurring one. - The community involved and whether there were clientele yet to be exploited   by anyone. I close this blog post with a final quote, one from Zvulony & Co’s blog post on this subject. Again, all of this is not official legal advice, but I think we can see what all these sources are pointing towards. To answer my earlier question, there’s no teeth behind the threat of the bite. In light of this list, and the decisions in Lyons and Orlan, it is reasonably certain that in most employment situations a non-competition clause will be ineffective in protecting an employer from a departing employee who wishes to compete in the same business. The Courts have been relatively consistent in their position that if a non-solicitation clause can protect an employer’s interests, then a non-competition clause is probably unreasonable. Employers (or their solicitors) should avoid the inclination to draft restrictive covenants in broad, catch-all language. Or in other words, when drafting a restrictive covenant – take only what you need! D

  • .htaccess file size causes 500 Internal Server Error

    As soon as my .htaccess goes over approx 8410 bytes, I get a 500 Internal Server Error. I don't think this is due to a bad redirect, as I have experimented with redirects in the .htaccess and then with just text that is commented out #. (no actual commands in the .htaccess file) Is there anything obvious that can cause this? Update: The site is on WordPress.     When we start the linux system it take only 435mb memory and it is 4GB memory server. When we start the httpd services it take 1000mb and outmatically it take all the memory and the server crase. even we stop the apache just it release 200mb memory. What I found out is that Jaime is a very experienced IDM Architect with several major projects under his belt. Darin Pendergraft: Can you tell me a bit about your experience? How long have you worked in IT, and what is your IDM experience? Jaime Cardoso: I started working in "serious" IT in 1998 when I became Netscape's technical specialist in Portugal. Netscape Portugal didn't exist so, I was working for their VAR here. Most of my work at the time was with Netscape's mail server and LDAP server. Since that time I've been bouncing between the system's side like Sun resellers, Solaris stuff and even worked with Sun's Engineering in the making of an Hierarchical Storage Product (Sun CIS if you know it) and the application's side, mostly in LDAP and IDM. Over the years I've been doing support, service delivery and pre-sales / architecture design of IDM solutions in most big customers in Portugal, to name a few projects: - The first European deployment of Sun Access Manager (SAPO – Portugal Telecom) - The identity repository of 5/5 of the Biggest Portuguese banks - The Portuguese government federation of services project DP: OK, in your blog response, you mentioned 3 topics: 1. Using Oracle's standards based architecture; (you) were able to integrate any new system in days: can you give an example? What systems, how long did it take, number of apps/users/accounts/roles etc. JC: It's relatively easy to design a user management strategy for a static environment, or if you simply assume that you're an <insert vendor here> shop and all your systems will bow to that vendor's will. We've all seen that path, the use of proprietary technologies in interoperability solutions but, then reality kicks in. As an ISP I recall that I made the technical decision to use Active Directory as a central authentication system for the entire IT infrastructure. Clients, systems, apps, everything was there. As a good part of the systems and apps were running on UNIX, then a connector became needed in order to have UNIX boxes to authenticate against AD. And, that strategy worked but, each new machine required the component to be installed, monitoring had to be made for that component and each new app had to be independently certified. A self care user portal was an ongoing project, AD access assumes the client is inside the domain, something the ISP's customers (and UNIX boxes) weren't nor had any intention of ever being. When the Windows 2008 rollout was done, Microsoft changed the Active Directory interface. The Windows administrators didn't have enough know-how about directories and the way systems outside the MS world behaved so, on the go live, things weren't properly tested and a general outage followed. Several hours and 1 roll back later, everything was back working. But, the ISP still had to change all of its applications to work with the new access methods and reset the effort spent on the self service user portal. To keep with the same strategy, they would also have to trust Microsoft not to change interfaces again. Simply by putting up an Oracle LDAP server in the middle and replicating the user info from the AD into LDAP, most of the problems went away. Even systems for which no AD connector existed had PAM in them so, integration was made at the OS level, fully supported by the OS supplier. Sun Identity Manager already had a self care portal, combined with a user workflow so, all the clearances had to be given before the account was created or updated. Adding a new system as a client for these authentication services was simply a new checkbox in the OS installer and, even True64 systems were, for the first time integrated also with a 5 minute work of a junior system admin. True, all the windows clients and MS apps still went to the AD for their authentication needs so, from the start everybody knew that they weren't 100% free of migration pains but, now they had a single point of problems to look at. If you're looking for numbers: - 500K directory entries (users) - 2-300 systems After the initial setup, I personally integrated about 20 systems / apps against LDAP in 1 day while being watched by the different IT teams. The internal IT staff did the rest. DP: 2. Using Federation allows the business to keep options open for buying and selling companies, and yet maintain a single view for both employee and customer. What do you mean by this? Can you give an example? JC: The market is dynamic. The company that's being bought today tomorrow will be sold again. Companies that spread on different markets may see the regulator forcing a sale of part of a company due to monopoly reasons and companies that are in multiple countries have to comply with different legislations. Our job, as IT architects, while addressing the customers and employees authentication services, is quite hard and, quite contrary. On one hand, we need to give access to all of our employees to the relevant systems, apps and resources and, we already have marketing talking with us trying to find out who's a customer of the bough company but not from ours to address. On the other hand, we have to do that and keep in mind we may have to break up all that effort and that different countries legislation may became a problem with a full integration plan. That's a job for user Federation. you don't want to be the one who's telling your President that he will sell that business unit without it's customer's database (making the deal worth a lot less) or that the buyer will take with him a copy of your entire customer's database. Federation enables you to start controlling permissions to users outside of your traditional authentication realm. So what if the people of that company you just bought are keeping their old logins? Do you want, because of that, to have a dedicated system for their expenses reports? And do you want to keep their sales (and pre-sales) people out of the loop in terms of your group's path? Control the information flow, establish a Federation trust circle and give access to your apps to users that haven't (yet?) been brought into your internal login systems. You can still see your users in a unified view, you obviously control if a user has access to any particular application, either that user is in your local database or stored in a directory on the other side of the world. DP: 3. Cut response times of audit and security teams to 1/10. Is this a real number? Can you give an example? JC: No, I don't have any backing for this number. One of the companies I did system Administration for has a SOX compliance policy in place (I remind you that I live in Portugal so, this definition of SOX may be somewhat different from what you're used to) and, every time the audit team says they'll do another audit, we have to negotiate with them the size of the sample and we spend about 15 man/days gathering all the required info they ask. I did some work with Sun's Identity auditor and, from what I've been seeing, Oracle's product is even better and, I've seen that most of the information they ask would have been provided in a few hours with the help of this tool. I do stand by what I said here but, to be honest, someone from Identity Auditor team would do a much better job than me explaining this time savings. Jaime is right: the Oracle IDM products have a lot of business value, and Oracle IT is using them for a lot more than I was able to cover in the short podcast that I posted.   • Help With Database Layout

    Hello everyone, I am working on a site similar to Craigslist where users can make postings and sell items in different cities. One difference between my site and Craigslist will be you will be able to search by zip code instead of having all of the cities listed on the page. I already have the ZIP Code database that has all of the city, state, latitude, longitude, and zip code info for each city. Okay, so to dive into what I need done and what I need help with: 1.) Although I have the ZIP Code database, it is not setup perfectly for my use. (I downloaded it off of the internet for free from http://zips.sourceforge.net/) 2.) I need help setting up my database structure (Ex: How many different tables should I use and how should I link them) I will be using PHP and MySQL. These our my thoughts so far on how the database can be setup: (I am not sure if this will work though.) Scenario: Someone goes to the homepage and it will tell them, "Please enter your ZIP Code.". If they enter "17241" for example, this ZIP Code is for a city named Newville located in Pennsylvania. The query would look like this with the current database setup: SELECT city FROM zip_codes WHERE zip = 17241; The result of the query would be "Newville". The problem I see here now is when they want to post something in the Newville section of the site, I will have to have an entire table setup just for the Newville city postings. There are over 42,000 cities which means I would have to have over 42,000 tables (one for each city) so that would be insane to have to do it that way. One way I was thinking of doing it was to add a column to the ZIP Code database called "city_id" which would be a unique number assigned to each city. So for example, the city Newville would have a city_id of 83. So now if someone comes and post a listing in the city Newville I would only need one other table. That one other table would be setup like this: CREATE TABLE postings ( posting_id INT NOT NULL AUTO_INCREMENT, for_sale LONGTEXT NULL, for_sale_date DATETIME NULL, for_sale_city_id INT NULL, jobs LONGTEXT NULL, jobs_date DATETIME NULL, jobs_city_id INT NULL, PRIMARY KEY(posting_id) ); (The for_sale and job_ column names are categories of the types of postings users will be able to list under. There will be many more categories than just those two but this is just for example.) So now when when someone comes to the website and they are looking for something to buy and not sell, they can enter their ZIP Code, 17241, for example, and this is the query that will run: SELECT city, city_id FROM zip_codes WHERE zip = 17241; //Result: Newville 83 (Please note that I will be using PHP to store the ZIP Code the user enters in SESSIONS and Cookies to remember them throughout the site) Now it will tell them, "Please choose your category.". If they choose the category "Items For Sale" then this is the query to run and sort the results: SELECT posting_id, for_sale, for_sale_date FROM postings WHERE for_sale_city_id = $_SESSION['zip_code']; Will this work? So now my question to everyone is will this work? I am pretty sure it will but I do not want to set this thing up and realize I overlooked something and have to start from all over from scratch.   • iPhone Store Kit returning invalid product ID errors

    Hello, I am trying to test In App Purchases on my iPhone and running into a problem where the product IDs I request information for end up being returned to me as invalid product IDs in the "didRecieveResponse" method. I have: Created an in store product associated with this app. It's bundle ID matches everything else. It has been cleared for sale and approved by the developer. Made sure my new provisioning profile has in store app purchases enabled and it has the full app name: "com.domain.appname" Made sure this is the provisioning profile being used to sign the app to my iPhone. Made sure that "com.domain.appname" is the app ID used to build the provisioning profile. Made sure that "com.domain.appname" is used in my plist file as the bundle identifier. Everything seems to be in place, however I still get my products returned to me as invalid IDs.
