  • Rights and use of developed software

    I have been working on a piece of software for a company, that they wish to resell. There was an mail-based agreement upon a flat hourly rate for my work, and eager me chose to accept a rather low fee. Due to the stress and tempo of the task, a direct contract was never formed or signed. The software was developed locally on my machine, and I was pretty much alone with it, except by excellent help from StackOverflow when I got stuck. Now, the software is nearing completion, I suddenly hear that they have hired a new developer to make the same piece of software as me, and that I was expected to resign within long. Confused I ask around, and realize that the CEO of the company had informed the rest of the company that I was terminally ill and had cancer, and was expected to leave the company soon. Since I'm perfectly healthy, this confused me even more, until I realized what was going on. When I confronted my boss with this, I was no longer seen as a member of the company, and I left the same day, never to return. Later, I raised the question about my missing pay, since I had been working for quite a bit, and not received any payment for my software. I saw that they had already sold a fair copy of my software, and since it's not exactly sold cheap, the company should have plenty of gold to pay me. The company refused, and said that they owned the software, and everything it contained. That was a lot of drama, but my question is this: Who has the rights to the software ? The source code had my personal watermarks and copyrights inprinted, but they have since simply deleted it. The company claim that they have all the rights, because they have a website made about the product, where they write that they have "All rights reserved" in the bottom. My instinct tells me that if a company buys a service like this, and then refuses to pay their developer, then they should not be allowed to keep, and much less resell the product. I have not signed any agreements about giving the company the use of this product, I have made it in my own time and without help from the rest of the company. This all takes place in Denmark, Europe, but I would guess that the rules about this is somewhat universal. Im not the strongest person to legal-talk, so I might be wrong.

WPTG offer expertise in fields such as process engineering, tools development, linguistic quality, terminology, global product release, financial and vendor management. WPTG provides translation solution for over 40 languages including Asia Pacific, European, American and Middle Eastern languages. WPTG first introduced an intern program over 10 years ago and it has become a key component of our teams structure. The majority of Interns are sourced from a Computer Science related course, these Interns joining the engineering team. Others are sourced from Business courses and work within the Business / Project management area. The intern program allows us to maintain ties with current course curriculum and brings fresh energy and perspective into our Organisation. Four of the full time staff working in Dublin today joined us originally as Interns and subsequently were offered permanent positions.   • NRF Big Show 2011 -- Part 2

    One of the things I love about attending NRF is visiting the smaller booths to see what new innovative ideas have sprung up. After all, by watching emerging technologies we can get a sense of how the retail experience might change. After NRF I'm hoping to write a post on what I found, if anything, so be sure to check back. At the Oracle Retail booth we'll be demonstrating some of the aspects of the changing retail experience. These demos use a mix of GA and experimental components. Here are some highlights: 1. Checkin We wrote a consumer iPhone app we call Store Gateway that lets consumers access information from the store. They'll start by doing a checkin when they arrive that will alert the store manager via another iPhone app we wrote called Mobile Manager. Additionally, we display a welcome messaging using Starmount's digital sign. 2. Receive Offers There are three interaction points where a store can easily make an offer to a consumer: checkin, product scans, and checkout. For this demo we're calling our Universal Offer Engine at checkin to determine the best offer for this particular consumer. This offer is then displayed on the consumer's phone as well as on the digital sign. 3. Scan Products To thwart consumers from scanning product barcodes, we used Store Inventory Management to print QRCodes on shelf label then provided access to a scanner in the Store Gateway iphone app. When the consumer scans the shelf label they are shown product information provided by the retailer. 4. Checkout While we don't have a NFC-enabled mobile phone, we have a NFC chip that can attach to a phone. We're using this to checkout using a reader provided by ViVOTech. Tap the phone on the reader, and the POS accesses the customer#, coupons, and payment information. This really speeds the checkout process. 5. Digital Receipt After the transaction is complete, a digital copy of the receipt is sent to Intuit's QuickReceipts where consumers to store all their digital receipts. There's even an iPhone app that provides easy access to the receipts. This covers about half of what what we'll be showing, so be sure to stop by.     I have a class diagram that is like this: < Order > (1) CAN HAVE (M) < products > But therefore "Order" has the following: Order_Id Customer_Id Order_date_day Order_date_month Order_date_yeah But I do not know how it would handle the Products? Because, I couldn't have "ProductID" because that would mean that each item in this class would have to have a separate instance for each product (E.g. someone ordered 100 products, but only placed 1 order). Could I have an Product object in class Order? If so, how do you represent that in UML? Thank you

  • What if you could work on anything you wanted?

    This week we've downed our tools and organised ourselves into small project teams or struck out alone. We're working on whatever we like, with whoever we like, wherever we like. We've called it Down Tools week and so far it's a blast. It all started a few months ago with an idea from Neil, our CEO. Neil wanted to capture the excitement, innovation, and productivity of Coding by the Sea and extend this to all Red Gaters working in Product Development. A brainstorm is always a good place to start for an "anything goes" project. Half of Red Gate piled into our largest meeting room (it's pretty big) armed with flip charts, post its and a heightened sense of possibility. An hour or so later our SQL Servery walls were covered in project ideas. So what would you do, if you could work on anything you wanted? Many projects are related to tools we already make, others are for internal product development use and some are, well, just something completely different. Someone suggested we point a web cam at the SQL Servery lunch queue so we can check it before heading to lunch. That one couldn't wait for Down Tools Week. It was up and running within a few days and even better, it captures the table tennis table too. Thursday is the Show and Tell - I am looking forward to seeing what everyone has come up with. Some of the projects will turn into new products or features so this probably isn't the time or place to go into detail of what is being worked on. Rest assured, you'll hear all about it! We're making a video as we go along too which will be up on our website as soon. In the meantime, all meetings are cancelled, we've got plenty of food in and people are being very creative with the £500 expenses budget (Richard, do you really need an iPad?). It's brilliant to see it all coming together from the idea stage to reality. Catch up with our progress by following #downtoolsweek on Twitter.   • keyboard status leds not working

    Running Ubuntu 13.10 64bit The status leds are not working correctly on my new keyboard under Ubuntu. Pressing Caps Lock and Num Lock do not cause the leds to turn on/off to reflect their status. Rather I have a num lock led stuck on, and a caps lock led that never turns on. The actual function of the caps lock and num lock is unaffected though, just the leds not working. I am able to use ¨setleds¨ to turn the leds on an off from a console session, so I don´t think there's any hardware problem. Also the keyboard does not have the same problem under windows 7. Anyone have any solutions? thanks!   • Evaluating Scrum - is it okay to have people with multiple roles in a Scrum team?

    I'm evaluating some Agile-style methodologies for possible introduction to my team. With Scrum, is it allowable to have the same person perform multiple roles? We have a small team of four developers and a web designer; we don't really have a lead (I fulfill this role), QA testers or business analysts, and all of our development tasks come from the CIO. Automated testing is seen as a total waste of time, and everything focuses on speed and not quality. What will happen is the CIO will come up with a development task (whether a feature or a bug) and give it to a developer (not to the whole team, to an individual, often in private or out of the blue) who is then expected to get it completed. The CIO doesn't gather requirements beyond the initial idea (and this has bitten us before as we'll implement something only to find out that none of the end users can use the feature, because they weren't consulted or even informed about it before we developed it, and in a panic we'll be told to revert the change) but requires say in/approval of everything that we do. First things first, is a Scrum style something to consider to introduce some standards and practices? From reading, Scrum seems to rely on a bit more trust and communication and focuses more on project management than on development, which is something we are completely devoid of as we don't have any semblance of project management at present. Second, if it can work is it unreasonable for someone, let's say myself, to act as both ScrumMaster and a developer? Or for a developer to also be the Product Owner (although chances are this will be the CIO, who isn't a developer)? I realize the Scrum Master and the Product Owner should be different people but at the same time I don't think we have anyone who has the qualities of a Product Owner (chances are it would turn into a "I need all these stories, I don't care how but get it done" type of deal and/or any freeze would be unfrozen on a whim). It seems to me that I might need to pick and choose pieces of Scrum/XP/Lean to compensate for how things are done currently, as it's highly unlikely that the mentality can be changed; for instance Pair Programming would never fly (seen as a waste, you get half the tasks done if you need two people for everything), TDD would be a hard sell, but short cycles would be welcomed.

  • Does having multiple URIs mapping to the same resource help SEO?

    Let's say I have a site with products that have tags, if each resource is available at GET '/products/tagged/:tag_list/:product_permalink' Could that be better for SEO than just one permalink? For example a product tagged "tea" and "coffee" would be available at GET '/products/tagged/tea/:product_permalink' GET '/products/tagged/coffee/:product_permalink' GET '/products/tagged/tea/coffee/:product_permalink' GET '/products/tagged/coffee/tea/:product_permalink' I would imagine that google would appreciate this because it gives multiple URIs with different levels of detail about the product, but I cant really be certain. Anyone have any direct knowledge on the topic? --EDIT-- As John Conde points, this is a horrible idea. What about having the links on my site link to a route such as GET '/products/tagged/:full_tag_list/:product_permalink', and then any time a user changes tags just have a HTTP moved permanently status to the new URL. Therefore duplicate URLs would be highly unlikely and mitigated by the proper response. Would this be better?

  • A Hot Topic - Profitability and Cost Management

    Maybe it's due to the recent recession, or current economic recovery but a hot topic and area of focus for many organizations these days is profitability and cost management.  For most organizations, aggressive cost-cutting and cost management were critical to remaining profitable while top line revenue was flat or shrinking.  However, now we are seeing many organizations taking a more "surgical" approach to profitability and cost management, by accurately allocating revenue and costs to individual product lines, services, customer segments, locations, channels and other lines of business to understand which ones are truly profitable and which ones are not.  Based on these insights, managers can make more informed decisions about which products or services to invest in or retire, how to price their products or services for different customer segments, and where to focus their marketing and customer service resources. The most common industries where this product, service and customer-focused costing and profitability analysis is being adopted include financial services, consumer packaged goods, retail and manufacturing.  However we are seeing adoption of profitability and cost management applications in other industries and use cases.  Here are a few examples: Telecommunications Industry:  Network Costing and Management to identify the most cost effective and/or profitable network areas, to optimize existing resources, infrastructure and network capacity.  Regulatory Cost Accounting to perform more accurate allocations of revenue and costs across services and customer segments, improve ability to set billing rates for future periods, for various products and customer segments and more easily develop analysis needed for rate case proposals. Funding Support:  Regulations require public sector funding requests to be evaluated based upon the ability to achieve performance goals against the associated cost.   Improved visibility and understanding of costs of different programs/services means that organizations can demonstrably monitor performance and the associated resource costs improve the chances of having their funding requests granted.   • Video monetising and simple shop, platform?

    I have this client that wants a single-product website. The product is a training-video that they want to deliver virtually and optionally physically. I usually do all the front-end design and back-end development but the budget is close to $0 to start with. So I'm looking for a platform like shopify or something where a shop/cart can be set up quickly and simply with minimal up-front cost - but which can accomodate some kind of paywall (DRM too?) for the online video with an option to purchase for an aditional cost the physical DVD. Am I approaching the wrong way all together? Or do you know of any platform that will accomodate the specs?

  • EPM Architecture: Foundation

    This post is the first of a series that is going to describe the EPM System architecture per component. During the following weeks a couple of follow up posts will describe each component. If applicable, the component will have its standard port next to its name in brackets. EPM Foundation is Java based and consists of two web applications, Shared Services and Workspace. Both applications are accessed by browser through Oracle HTTP Server (OHS) or Internet Information Services (IIS). Communication to the backend database is done by JDBC. The file system to store Lifecycle Management (LCM) artifacts can be either local or remote (e.g. NFS, network share). For authentication purposes, the EPM Product Suite can connect to external directories or databases. Interaction with other EPM Suite components like product specific Lifecycle Management connectors or Reporting and Analysis Web happens through HTTP protocol. The next post will cover Reporting and Analysis.
